There are 731 School Districts in New York.But how many of these Districts have established an effective security plan?An effective plan incorporates armed resource personnel. The South Huntington School District (SHUFSD) knows this and has designed a plan for school security utilizing armed resource personnel. On Wednesday, January 25, 2023, updated on January 26, 2023, two reporters, John Asbury and Craig Schneider, writing for “Newsday,” a leading news source for Long Island and New York City, discussed this plan. They said, “Armed guards will be stationed outside all South Huntington school buildings by the end of the month, one of several Long Island districts making that choice as school shootings continue to be a terrifying national trend.” The reporters added, that, “[t]he South Huntington school board voted unanimously Wednesday to implement the new security measure.” In a follow-up “Newsday” article, published on January 28, 2023, the reporter, Craig Schneider, cited remarks of Dennis Callahan, who heads the South Huntington Teachers’ Union, writing,“The head of the teachers union for South Huntington schools said Friday that his members have strong but very different opinions on the district's decision Wednesday to use armed guards at schools.‘I have members who are thrilled about it and others who are vehemently opposed,’ said Dennis Callahan, who also teaches AP Spanish at Walt Whitman High School in the district.The South Huntington school board voted unanimously to spend $750,000 to hire an undisclosed number of armed guards, who officials said will be stationed outside the seven school buildings by the end of the month. School Superintendent Vito D'Elia pointed to the long string of shootings in school settings in this country.On Friday, Callahan said teachers supporting the move ‘say we are in an unsafe world, and we need to do everything in our power to ensure that when students come to school in the morning, they get home safe.’Those opposed, he said, worry that ‘bringing weapons into school opens the door to more violence.’”How can the utilization of armed resource officers “open the door to more violence”? The idea is more than a trifle vague. Let’s delve into this.Are teachers who oppose armed resource officers afraid the officers would themselves turn on the students and administrators and staff, developing or harboring violent proclivities and thereupon becoming violent? If so, what evidence is there of any such incident ever before occurring in a school that utilizes armed resource officers? These teachers proffer none because there is none. Nothing like that has happened. And there is no reason to suggest an incident of this sort would ever happen. The idea does not merit serious consideration. It leads one down a blind alley.What then can one make of the claim that utilizing armed resource officers would open the door to more violence? Perhaps, teachers who oppose a school security plan utilizing armed officers simply abhor the idea of guns in the school or on school grounds regardless of the benefits derived from having armed officers in the schools and thereupon conjure up an unlikely scenario. If so, there is, in the assertion, a note of hysteria, grounded on a neurotic phobic reaction to the very thought of “guns” and gun-wielding guards. We explore this idea, infra.Perhaps, as a sop to those teachers who suffer from an irrational fear of firearms, or, otherwise, in spite of that irrational fear of firearms felt by many within the District, the South Huntington Board of Education said armed personnel would be stationed outside school buildings, never inside the buildings.A school district that refuses to utilize armed resource officers cannot effectively “harden” schools against a dangerous armed threat. This should be obvious to everyone. Apparently, it isn’t since many school systems refuse to acknowledge this. A fanciful notion, devoid of demonstrative proof or logical validity, leads one down a blind alley. All the more horrific to consider that irrational feverish beliefs inform a school district’s policy decisions. And it is the children who pay the price.Consider: One of the largest school districts in the Country, the New York City School District (UFT), has opted out of using armed resource personnel.“Too many elected officials, school boards, and teachers’ union leaders propose solutions that don’t work.They aren’t interested in listening to parents who, increasingly, have little voice in the matter of their children’s education and no voice in the matter of their children’s personal safety while in school.Their solution to school shootings proposed boils down to one thing: ‘Get Rid of the Guns.’” See the Arbalest Quarrel article, satirically titled, “How to Guarantee Future School Shootings,” published, on November 17, 2022, by Stephen L. D’Andrilli, CEO and President of Arbalest Group, LLC.The failure of some people to recognize the difference between lawful uses for guns and unlawful criminal misuse points to the evident effectiveness of an elaborate propaganda campaign perpetrated on the public and vociferously and monotonously perpetuated for the last few decades.It is a campaign that involves many actors—news media, pundits, politicians, antigun activists, and powerful health organizations, like the “American Medical Association” (“AMA”) and the “Centers for Disease Control and Prevention” (“CDC”).These multivarious actors are all focused on and draft narratives around this thing, “Gun Violence.”Well, there are “Guns” in our society and there is “Violence” in our society, too. All that is true enough.But the words ‘Gun’ and ‘Violence’ aren’t synonymous. It is only thinking of the two as inseparably linked that would make it seem so.Conjoin two disparate words ‘Gun’ and ‘Violence’ and, voilà, the propagandist has, in that, a shorthand rhetorical device, ‘Gun Violence,’ a neologism—one in service to an insidious agenda, centered around a nefarious end, injurious to a free Constitutional Republic: the disarming of the American citizenry.The aim is the elimination of the natural law right of the people to keep and bear arms in defense of self and in defense of innocent others.Americans will not readily sacrifice their Bill of Rights. They must be urged to do so.It takes ingenuity and subterfuge to coax Americans to willingly forsake rights and liberties that no other people of any other nation on Earth possess.The phrase, “Gun Violence,” is a viral meme, infecting the psyche of the public. If the pursuit of public health and safety is the goal, the reduction of “Gun Violence” is the theme played and with little variation to get the public there. Or so the public is told. And many there are who swallow the lie.The American public is presented with the classic “false dilemma” fallacy narrative:TOTAL CIVILIAN DISARMAMENT AND A PEACEFUL, SAFE, WELL-ORDERED, WELL-ENGINEERED, HARMONIOUS, SOCIETY VERSUS THE WELL-ARMED CITIZEN AND CONTINUOUS, UNINTERRUPTED, SAVAGE, RAMPANT GUN VIOLENCE.THIS ONE OR THAT ONE ONLY: THE ONE OR THE OTHER, BUT NOT BOTH, AND NOT NOT EITHERBut the tension isn’t real. The armed citizen, which, in the context of schools, is the armed resource officer, does not aggravate the threat of criminal violence by virtue of being armed. This is contrary to the view of many teachers and board members. The officer mitigates and repels that armed aggressive threat. Similarly, the armed civilian citizen neither causes nor adds to criminal violence, but rather mitigates criminal violence.Many Americans fail to perceive this. Many simply cannot perceive this. But, perversely, many others have the desire not to perceive this.And, the UFT, for one, certainly cannot see this. That says much of the cunning of those who instigate this incendiary narrative of “Gun Violence” while being careful to omit any mention of “Criminal Violence.” There is a method to this madness.The propagandists emphasize the object “The Gun” while, at once, deemphasizing the agents of violence: “the Criminal” and “the Lunatic.”This false narrative has a profound effect on the policy choices that politicians see available to them. The policy choices made, invariably endanger, rather than safeguard, their respective communities.Similarly, this false narrative has a profound effect on the choices that school districts make when designing a security plan for their schools. Some districts eschew the “hardening” of schools altogether, single-mindedly focused, as they are, on their abhorrence of “Guns.” Focusing entirely on guns, they conclude that children cannot be safe until or unless all guns are eliminated from society. That is impossible, a ridiculous demand, and one that would not prevent rampant violence anyway, as long as criminals and lunatics run amok in society. And, they would continue to run amok. The forces that crush western nations and people realize the usefulness of sociopathic and psychopathic elements to destabilize nation-states if allowed to do so, and they are given free rein to do just that in the United States.Such absolutism compels one to believe falsely in the futility of securing schools from harm. But Progressives, who ascribe to this absolutism comprise the majority of these School Boards. They make all kinds of excuses for the behavior of the worst sort of deviant types, placating them, unable to comprehend that these same lunatics and psychopaths have no regard for the hand that feeds it, and will readily bite it off if given the chance. So, these Progressives, these smug do-gooders, vent their wrath on Americans who would dare exercise their right to armed self-defense to thwart the destructive elements allowed to pillage and destroy businesses, homes, people, and institutions, with abandon.  Progressives comprise the majority of these School Boards. They make all kinds of excuses for the behavior of the worst sort of deviant influences, placating them, unable to comprehend that these same lunatics and psychopaths have no regard for the hand that feeds it, and will readily bite it off if given the chance. Instead, these Progressive do-gooders, vent their wrath on Americans who would dare exercise their right to armed self-defense to thwart the destructive elements allowed to pillage and destroy businesses, homes, people, and institutions, with abandon.  These Progressives direct their energy against the average law-abiding, rational, responsible, gun-owners, and against the mechanism of their survival, the firearm, believing firmly, and nonsensically, that disarming the gun owner and destroying guns will safeguard society, secure the public schools, and protect the children. It will do no such thing.  Consistent with that belief system, Progressive members of School Boards believe safeguarding children is impossible where guns are prevalent in society. Knowing that they will not get rid of guns nor that they will be able to defeat the exercise of the natural law right to armed self-defense, these Progressive school board members, disgruntled, and enraged, but refusing to acknowledge defeat, forsake designing, and implementing any security measures, hoping and trusting or simply desirous that the life of their charges will one day, in a Golden Age, be safeguarded once guns all disappear from the face of the Earth. Till, then, they will do nothing to protect the children in their schools. It is a kind of Nihilism that sweeps through these School Districts, pervading all thought, a sickness hidden in plain sight only because the highest officials and functionaries of Government suffer from the same ailment, a psychic disturbance wrought by those poor sorts that have inculcated the psychotic dogma of Diversity, Equity, and Inclusion, a dogma incompatible with our Nation's rational historical, political-philosophical creed, embodied in our natural law rights, emanating from the Divine Creator, that the new false secularism repudiates out of hand.These school districts hope the children in their care will be safe but believe they really won't be, and that, since nothing can be done, to prevent, in their mind, harm to their charges, they feel it is senseless to even try. So, they won't.This bizarre position emanates directly from the thinking of the repugnant Biden Administration itself. And, unsurprisingly, but no less unfortunate, many school districts, including the UFT, take their cue from this Federal Government. See June 6, 2022, report in Breitbart.And, since the public psyche is infected with the false notion that the existence of guns invariably threatens the physical and emotional health and safety of children, many public schools around the Country have opted out of employing armed personnel in schools.So it is, that some school districts, apparently so disheartened, disillusioned, and embittered as a result of their obsessive fear over the “proliferation” of guns and this thing, “Gun Violence,” have refrained from undertaking instituting any measures whatsoever. Consider, e.g., a 2007 report from the “National Institutes of Health” (“NIH”), that must bear some responsibility for this.A long-running campaign of psychological conditioning, undertaken by a plethora of organizations over a broad landscape of institutions, often operating in concert, and on an industrial scale, has succeeded in causing psychopathy in the minds of many Americans.And this elaborate propaganda campaign negatively impacts the decisions political leaders make: Governors of States, Mayors of Cities, and Members of School Boards.So powerful is this propaganda campaign that many Americans do not distinguish, indeed cannot distinguish, between criminal use of guns on the one hand, and non-criminal proper, lawful use of guns by average, rational, responsible, law-abiding people, on the other hand.The founders of our free Constitutional Republic would be puzzled indeed to consider that such a failure of reason could gain such wide currency.The founders of our Republic, the framers of our Constitution were acutely aware of the profound importance of firearms to both the creation of and maintenance of a free RepublicThey were certainly aware of the profound importance of firearms to the creation of and maintenance of a free Republic where the common man would stand and must stand sovereign over Government lest tyranny arise, as tyranny must, where good men have neither the will nor the means to prevent it.Guns are only a tool, inanimate objects, but necessary ones. Like any tool, a gun can be utilized for good or ill, dependent upon the nature of the sentient agent who wields it. A “firearm,” being insentient, is incapable of engaging in harm initiated by itself but listening to antigun zealots, one tends to hear them argue otherwise.The founders of our free Constitutional Republic certainly were aware of the importance of firearms as the most effective means to successfully safeguard human life from predatory creatures, predatory men, and predatory Governments. Our Country would not exist without the will and courage of these men, our Founders, and the means required to repel tyranny.Knowing this, one is left to ponder that——The failure of so many Americans to recognize the utility of firearms (“Guns”) as a source of positive good must be by design.The danger to the life, safety, and well-being of innocent Americans, especially children, is palpable.Sadly, there are powerful, ruthless forces machinating against the well-being of our Nation and its people, and they exert that influence on politicians at all levels of Government, and on businesses, media, the Press, and school boards across the Nation—with devastating effect. The felt impact of this, demonstrated by the money and time spent to undermine the natural law right to armed self-defense, is too much in evidence to be reasonably denied.Inducing in the psyche of a person a deep-seated phobia toward “the Gun,” such that a person finds nothing salvageable in it, suggests a dark and sinister intent of powerful forces to disarm the citizenry. WHY DO SOME STATE GOVERNMENTS AND THE FEDERAL GOVERNMENT BLATANTLY DEFY SECOND AMENDMENT RULINGS OF THE UNITED STATES SUPREME COURT?

Scarcely eight years had passed since ratification of the U.S. Constitution in 1788 when the question of the power and authority of the U.S. Supreme Court came to a head in the famous case of Marbury versus Madison. The High Court made its authority felt in a clear, cogent, categorical, and indisputable language in this seminal 1803 case.The facts surrounding the case are abstruse, generating substantial scholarly debate. But what some legal scholars discern as having little importance to the logical and legal gymnastics the Court at the time had to wrestle with, and upon which legal scholars, historians, and logicians have directed their attention today, has become a cause célèbre today:“It is emphatically the province and duty of the judicial department to say what the law is. Those who apply the rule to particular cases, must of necessity, expound and interpret that rule. If two laws conflict with each other, the courts must decide on the operation of each. . . . This is of the very essence of judicial duty.” Marbury vs. Madison, 5 U.S. 137; 2 L. Ed. 60; Cranch 137 (1803)Article 3, Section Two of the U.S. Constitution establishes the powers of the Court:“The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution. . . .” The Constitution’s Framers sought to make the import of the articles and amendments to it as plain and succinct. And they did a good job of it.Even so, ruthless, powerful individuals in the Federal Government and in the States ever strive to thwart the plain meaning and purport of the U.S. Constitution in pursuit of their own selfish interests, imputing vagaries to language even where the language is plain and unambiguous to serve their own selfish ends to the detriment of both Country and people. And that ruthlessness extends to those who, with vast sums of money at their disposal, influence these “servants of the people,” in pursuit of and to achieve their own nefarious interests and goals.Back then, over two centuries ago, when the U.S. Supreme Court agreed to hear the case of Marbury vs. Madison, the Court deftly side-stepped the delicate political and legislative issues of the day that gave rise to the case and carved out the Court’s own territory.The High Court made two points abundantly clear:One, the U.S. Supreme Court does not answer to either the Executive or Legislative Branch. It is not to be perceived as a poor stepchild of either of those two Branches. It is a Co-Equal Branch of the Federal Government.Two, on matters impacting the meaning and purpose of the U.S. Constitution, neither the U.S. President nor Congress can lawfully ignore the Court’s rulings. This means that, where the Court has spoken on challenges to unconstitutional laws, finding particular laws of Congress to be unconstitutional, Congress has no lawful authority to ignore and countermand those rulings, or circumvent those rulings by enacting new laws that purport to do the same thing as the laws that the Court has struck down. Nor can the U.S. President cannot override the Constitutional constraints imposed on his actions.The States, too, are forbidden to ignore Supreme Court rulings, striking down unconstitutional State enactments. Nor are the States permitted to repurpose old laws or create new laws that do the same thing—operate in violate of the U.S. Constitution.  Jump forward in time to the present day.The Federal Government and all too many State and municipal Governments routinely defy the High Court’s rulings, engaging in unconstitutional conduct.But this defiance and even contempt of the High Court rulings leaves an American to ponder, “why?”Even cursory reflection elucidates the answer to that question. The answer is as plain as the text of Article Three, Section 2 of the Constitution, itself.The High Court has neither power over “the purse” that Congress wields, nor power over the Nation’s “standing army” the Chief Executive controls.Yet, the fact remains the U.S. Supreme Court is the only Branch of Government with ultimate say over the meaning of the U.S. Constitution, as Marbury made clear, well over two hundred years ago. To say what the Constitution means, when conflict or challenge to that meaning arises is within the sole province of the High Court.Unfortunately, without the capacity to withhold funds over the operation of Government, nor power to enforce its judgments by force of arms, the Court’s rulings are all too often, blatantly ignored or cavalierly dismissed.As if this weren’t bad enough, the mere fact of the Court’s authority is now actively contested.Audaciously, some individuals in Government, in the Press, and in academia, have recently argued the U.S. Supreme Court’s authority to say what the law is, should not be vested in the High Court, regardless of the strictures of Article Three, Section Two of the U.S. Constitution.Consider, an Op-Ed, titled, “Should the Supreme Court Matter So Much?” The essay appeared in The New York Times, and not that long ago, in 2018, written by Barry P. McDonald, an attorney and Law Professor no less who exclaims:“When the founders established our system of self-government, they didn’t expend much effort on the judicial branch. Of the roughly three and a half long pieces of inscribed parchment that make up the Constitution, the first two pages are devoted to designing Congress. Most of the next full page focuses on the president. The final three-quarters of a page contains various provisions, including just five sentences establishing a ‘supreme court,’ any optional lower courts Congress might create and the types of cases those courts could hear.Why was the judicial branch given such short shrift? Because in a democracy, the political branches of government — those accountable to the people through elections — were expected to run things. The courts could get involved only as was necessary to resolve disputes, and even then under congressional supervision of their dockets.It was widely recognized that the Supreme Court was the least important of the three branches: It was the only branch to lack its own building (it was housed in a chamber of Congress), and the best lawyers were seldom enthusiastic about serving on it (John Jay, the Court’s first chief justice, resigned within six years and described the institution as lacking ‘energy, weight and dignity’).When disputes came before the Supreme Court, the justices were expected to ensure that Americans received ‘due process’ — that they would be ruled by the ‘law of the land’ rather than the whims of ruling individuals. In short, the Court was to play a limited role in American democracy, and when it did get involved, its job was to ensure that its judgments were based on legal rules that were applied fairly and impartially.What about the task of interpreting the Constitution? This question is the subject of some debate, but the founders most likely believed that each branch of government had the right and duty to determine for itself what the Constitution demanded, unless the Constitution was clearly transgressed. If the Constitution was clearly transgressed, the Supreme Court had a duty to hold Congress or the president accountable — but only in the case before it. The founders almost certainly did not envision a roving mandate for the Supreme Court to dictate to Congress, the president or state governments what actions comported with the Constitution (unless they were a party to a case before it).” The question of interpreting the Constitution is the subject of some debate? Really? Apparently, this Law Professor, Barry McDonald, has wholly forgotten the import of Marbury versus Madison, a case burnt into the mind of every first-year law student. His remarks are eccentric, disturbing, and disheartening.If the Framers of the U.S. Constitution really had such a low opinion of the High Court, they would not have constructed a Government with a Third Branch but would have subsumed it into one of the first two? Obviously, the Framers thought enough about the singular importance of the U.S. Supreme Court, to include it in the framework of the Federal Government, and as a co-equal Branch of that Government.It is one thing to ignore the U.S. Supreme Court’s rulings because of an antipathy toward those rulings and claim the Court can’t do anything about it anyway because the Court hasn’t power to enforce its rulings. That is bad enough. But it is quite another thing to argue the Court has no reason to exist, ought not to exist, and thereupon rationalize doing away with the Third Branch of Government or otherwise reducing its authority to render rulings to a nullity by Executive Branch or Legislative Branch edict.Application of alien predilections, predispositions, and ideology to the Nation’s governance is a path to abject tyranny; to dissolution of the Republic; defilement of the Nation’s culture and history and heritage; destruction of societal order and cohesion; and abasement and subjugation of a sovereign people. The Nation is on a runaway train, running full throttle, about to make an impact with a massive brick wall.The New York Times just loves to publish articles by credentialed individuals who hold views well beyond the pale of those held by their brethren if those views happen to conform to, and strengthen, and push the socio-political narrative of the newspaper’s publishers and editorial staff.Use of such dubious, fringe views to support a viewpoint is a classic example ofconfirmation bias,” an informal fallacy.There are dozens of informal fallacies. And the American public is force-fed ideas that routinely exemplify one or more of them.This defiance of State and Federal Government actors to adhere to the Court’s rulings and even to contest the authority of the Court is most pronounced, most acute, and, unfortunately, most prevalent, in matters pertaining to the import of fundamental, unalienable rights and liberties of the American people—and none more so than the citizen’s right of armed self-defense.Consider——In the first decade of the 21st Century, the U.S. Supreme Court ruled clearly and unequivocally in Heller versus District of Columbia that the right of the people to keep and bear arms is an individual right, unconnected with one’s service in a militia. Associate Justice Antonin Scalia penned the majority opinion.Among its other rulings in Heller, the High Court held the District of Columbia’s blanket ban on handguns impermissibly infringes the core of the Second Amendment. It thereupon struck down the D.C. ban on handguns as unconstitutional.And the Court also held a person has a right to immediate access to a handgun in one’s self-defense. Not surprisingly, Anti-Second Amendment jurisdictions disliked these rulings and were intent on disobeying them, and arrogantly defied the Court.Looking for an excuse to defy Heller, these jurisdictions argued that Heller applies only to the Federal Government, not to them. That led to an immediate challenge, and the High Court took up the case in McDonald vs. City of Chicago.Here, Justice Alito writing for the majority, opined the Heller rulings apply with equal force to the States, through operation of the Fourteenth Amendment.Did the Anti-Second Amendment States abide by the Court’s rulings, after McDonald? No, they did not!They again defied the Court, conjuring up all sorts of reasons to deny to the American citizen his unalienable right to keep and bear arms in his self-defense.The States in these Anti-Second Amendment jurisdictions claimed that, even if a person has a right to armed self-defense inside his home, the right to do so does not extend to the carrying of a handgun outside the home.The State and Federal Courts in these jurisdictions conveniently misconstrued the Supreme Court’s test for ascertaining the constitutionality of Government action infringing exercise of the right codified in the Second Amendment. These Anti-Second Amendment jurisdictions also placed bans on semiautomatic weapons, fabricating a legal fiction for them; referring to them as “assault weapons.”  American citizens challenged the constitutionality of all these issues. And many of these cases wended their way up to the U.S. Supreme Court, only to be thwarted because the Court could not muster sufficient support among the Justices to deal with the flagrant violation of Second Amendment Heller and McDonald rulings and reasoning.One of these cases was the 2015 Seventh Circuit case, Friedman versus City of Highland Park, Illinois.The liberal wing of the Court didn’t want the case to be heard. That was no surprise.But, apparently, Chief Justice John Roberts, and Associate Justice Anthony Kennedy didn’t want to hear the case either.Justices Clarence Thomas and Antonin Scalia were furious and said so in a comprehensive dissenting opinion.Had the Court taken up the Friedman case, Americans would have been spared this nonsense of “assault weapon” bans. The Court would have ruled these bans unconstitutional on their face, in which event the Federal Government and Anti-Second Amendment State governments would be hard-pressed to make a case for wasting valuable time and taxpayer monies dealing with an issue the High Court had ruled on. Unfortunately, the Friedman case and many others were not taken up by the Court.Americans are compelled to continue to spend considerable time and money in challenging a continuous stream of unconstitutional Second Amendment Government action. NEW YORK GOVERNOR KATHY HOCHUL UNFAZED BY CHALLENGES TO NEW YORK GUN LAW: “GO FOR IT,” SHE RETORTS!

One of the most persistent and virulently Anti-Second Amendment jurisdictions, that has spurred numerous challenges to unconstitutional and unconscionable constraints on the Second Amendment through the decades, is New York.In 2020, four years after Associate Justice Antonin Scalia died, under disturbingly suspicious circumstances, and shortly after Justice Anthony Kennedy retired from the Bench, and the U.S. Senate confirmed President Donald Trump’s first nominee, Brett Kavanaugh, to a seat on the High Court, the Court took up the case, NYSRPA vs. City of New York—often referred to colloquially as the “NY Gun Transport” case. An extensive explication of that case is found in a series of AQ articles posted on our website. See, e.g., our article posted on April 27, 2020, and reposted in Ammoland Shooting Sports News on the same date. A second U.S. Supreme Court case, coming out of New York, NYSRPA versus Bruen, officially released on June 23, 2022, ruled New York’s “proper cause” requirement unconstitutional.New York Governor Kathy Hochul and the Democrat Party-controlled Legislature in Albany thereupon struck the words “proper cause” from the State’s Gun Law, the Sullivan Act, codified in Section 400.00 of the State’s Penal Code. But, doing so served merely as a blind.Had the Hochul Government refrained from tinkering with the rest of the text of the Statute and other Code sections, it might well have avoided further constitutional challenges from justifiably irate New Yorkers. It did not.Hochul and Albany did not stop with the striking of “proper cause” from the Gun Law. It went well beyond that. Her Government and Albany wrote a detailed set of amendments to the Gun Law. The package of amendments, titled the “Concealed Carry Law Improvement Act,” “CCIA,” do not conform to the Bruen rulings but, rather, slither all around them. On a superficial level, deletion of the words “proper cause” might be seen by some, as Hochul and Albany had perhaps hoped, to forestall legal challenge. But, if challenge came, time would be, after all, on the Government’s side. And Hochul knew this.The Government has money enough to fight a protracted Court battle. The challenger, more likely, does not. Even finding a suitable challenger takes considerable time, exorbitant sums of money to file a lawsuit, and substantial time to take a Second Amendment case to the U.S. Supreme Court. And it is far from certain the Court will review a case even if a petition for hearing is filed, for the Court grants very few petitions.For well over a century the New York Government has inexorably whittled away at the right of armed self-defense in New York. And it has successfully weathered all attacks all the while. The New York Government wasn’t going to let the U.S. Supreme Court now, in the Bruen case, to throw a wrench into attaining its end goal: the elimination of armed self-defense in New York. Much energy went into the creation of the CCIA. It is a decisive and defiant response to the U.S. Supreme Court and furthers its goal to constrain armed self-defense in the public sphere.Likely, given the length, breadth, and depth of the CCIA, the Government saw Bruen coming, long before the case was filed, and had ample time to draft the contours of the CCIA a couple of years ago. A clue that another U.S. Supreme Court case, challenging New York’s Gun Law, would loom, presented itself in Associate Justice Samuel Alito’s dissenting opinion, joined by Justices Clarence Thomas and Neil Gorsuch.  Justices Alito, Thomas, and Gorsuch had made known their strong disapproval of the way the “Gun Transport” case was handled, after the Chief Justice and Associate Justice Brett Kavanaugh cast their lot with the Anti-Second Amendment liberal wing of the Court, allowing the case to be unceremoniously and erroneously shunted aside, sans review of the merits of the case. A day of reckoning with New York’s insufferable Gun Law was coming. The Government of New York could not reasonably doubt that. The core of the Gun Law would be challenged, and the U.S. Supreme Court would hear that challenge. The Government likely worked up a draft response to an antagonistic U.S. Supreme Court ruling on the core of the Gun Law in 2020, shortly after the New York “Gun Transport” case ruling came down. That draft response would become the CCIA.The Government likely completed its draft of the CCIA well before Bruen was taken up by the High Court. The Government had only to fine-tune the CCIA immediately after oral argument in early November 2021. And the Government did so. Hochul almost certainly received advance notice of the text of the majority opinion within days or weeks after the hearing before the New Year had rung in. Nothing else can explain the speed at which Albany had passed the CCIA and Hochul had signed it into law: July 1, 2022, just eight days after the Court had released the Bruen decision, June 23, 2022.The CCIA amendments to the Gun Law integrate very nicely with and into other recent New York antigun legislation, passed by Albany and signed into law by Hochul. Thus, contrary to what the Governor’s website proclaims, the amendments were not “devised to align with the Supreme Court’s recent decision in NYSRPA v. Bruen.” Rather these amendments were devised to align with other New York antigun legislation. What does this portend for New Yorkers? Those New Yorkers who had hoped to be able to obtain a New York concealed handgun carry license with relative ease will now find procuring such a license no less difficult than before the enactment of the CCIA.Most hard-hit are those present holders of New York City and New York County unrestricted concealed handgun carry licenses. The “proper cause” hoop that present holders of such concealed handgun carry licenses were able to successfully jump through is of no use to them now. These renewal applicants must now satisfy a slew of new requirements—more draconian than the original ones they had previously successfully navigated. All New York concealed handgun carry applicants are now in the same boat. And meeting the new requirements are exceedingly difficult. Despite the clear intent of the Bruen rulings, to make it easier for more Americans to obtain a New York concealed handgun carry license, it is now harder. Likely, very few individuals will be able to successfully pass through the hurdles necessary to obtain a New York license the CCIA requires. Thus, getting a license will remain a coveted prize, difficult to gain as previously, and likely even more so.And the few individuals who do happen to secure a valid New York concealed handgun carry license will find themselves in a precarious situation for all the troubles they had in getting it.These new license holders will find exercise of the right of armed self-defense outside one’s home or place of business, in the public realm, full of traps and snares that did not previously exist. And there is something more alarming.The mere act of applying for a concealed carry license—whether the license is issued or not—now requires the applicant to divulge a wealth of highly personal information that, hitherto, an applicant never had to divulge, and the licensing authority had never asked an applicant to divulge. And, if a person fails to secure a license, his personal data will remain in his State police file, indefinitely, and will likely be turned over to the DOJ, DHS, ATF, IRS, and/or to a slew of State or Federal mental health agencies. All manner of harm may be visited upon the person that otherwise would not have occurred had the individual not bothered to apply for a New York concealed handgun carry license in the first place. To apply for a New York concealed handgun carry license, an applicant may unwittingly be alerting both the New York Government and the Federal Government that he is a “MAGA” supporter, and therefore a potential “Domestic Terrorist.” And, if so, he is then targeted for special treatment: surveillance, harassment, exploitation, or extortion. And he cannot claim a violation of his Fourth Amendment right to be free from unreasonable searches and seizures because he voluntarily relinquished that right when he applied for a concealed handgun carry license.If one thinks this is farfetched, consider the excesses committed by the Biden Administration directed to average Americans in the last several months.We explore these troubling matters, in connection with the application requirements for a New York concealed handgun carry license, in the next few articles.____________________________________Copyright © 2022 Roger J. NEW YORK’S HANDGUN LAW WAS ALWAYS A MESS—AND IT CONTINUES TO BE A MESS!

The Amendments to the New York State handgun regime are a “mess.” That one word is the best descriptor of them and for them, and for the entire State handgun licensing regime. These Amendments do nothing to alleviate the past difficulties an individual has had attempting to secure an unrestricted handgun carry license. These Post-Bruen Amendments merely substitute one ludicrous arbitrary and subjective, and vague handgun licensing standard, “Proper Cause”/ “Demonstration of Extraordinary Need,” for another nonsensical subjective and vague handgun licensing standard, “Demonstration of Good Moral Character.”The present New York Government, referring here to Governor Kathy Hochul and the Democrat Party-controlled Legislature in Albany, have manufactured a response to the Bruen rulings that is a sham, a dissembling, a pretense at satisfying the dictates of the Court—one that isn’t at all subtle.Implementation of the new handgun licensing standard makes it decidedly and decisively more difficult, not less so, for the average, responsible, rational, law-abiding civilian citizen, to obtain an unrestricted concealed handgun license. In fact, implementation of the new standard makes it more difficult for the average New Yorker to obtain even a restrictive home and/or business premise handgun license.The New York Government has brazenly defied, not obediently complied with, the Court’s Bruen rulings, thereby vitiating the import of Bruen, and violating the Court’s Article 3 Constitutional authority.In her words and actions, Hochul has made her feelings known, and the New York State Senate Majority Leader has echoed those sentiments.Contemptuous of the High Court’s rulings and reasoning, the New York State Senate Majority Leader, Andrea Stewart-Cousins, hurled a stream of invective, at the High Court. She regurgitated the same tiresome, disingenuous, and caustic rhetoric of Anti-Second Amendment fanatics and Neo-Marxist Cultists, proclaiming that the New York Nanny State knows what’s best for the people, not the U.S. Supreme Court. And so, the New York Government informs the Court that New York has no intention of complying with the Court’s rulings. In her Senate Majority Press Release, Andrea Stewart-Cousins retorts——“In response to the Supreme Court’s decision, implying that guns are more important than lives in this country, we are passing legislation to ensure that New York State has safe and responsible gun laws. States are the last line of defense, which is why we are stepping up to protect New York from being easily flooded with concealed weapons and keeping firearms out of the wrong hands. These measures, in addition to the previous anti-gun violence legislation we passed, are vital in a time when there are more guns than people in America. New York will continue to prioritize people’s safety and lives, and I thank my conference, Speaker Heastie, and Governor Hochul for their partnership.” ~New York State Senate Majority leader’s remarks after the NY Senate in Albany passed amendments to the State’s handgun licensing statute in response to the U.S. Supreme Court striking down the State’s concealed handgun carry law.The implication of Stewart-Cousins’ remarks is that the Government's changes to the handgun statute are designed to make it more difficult, not less difficult, for the average civilian citizen to exercise his or her right to armed self-defense in New York, thus necessitating the filing of further time-consuming and expensive lawsuits on the part of the citizen to obtain redress for Government's unconscionable, unconstitutional behavior.It is evident that the goal of the New York Government is to make the process of obtaining a New York handgun carry license—that one requires to lawfully possess a handgun in New York—so difficult, so onerous, so expensive, so time-consuming, so oppressive that one’s desire to exercise his or her natural law right to keep and bear arms is snuffed out, and the individual concedes defeat, and gives up further attempt to secure the right. Of course, some individuals will remain undeterred, and that is to be expected as long as the Second Amendment remains, de jure law, in the Bill of Rights—a thing that angers and frustrates the Neoliberal Globalists and Neo-Marxist internationalists to no end. For, as long as the Second Amendment remains explicit in the Constitution, the sovereignty of the American people cannot be disturbed, and United States, as a free Constitutional Republic, and independent Nation-State cannot be dismantled and its remains inserted into the “international rules-based neo-feudalistic, neoliberal empire,” a.k.a. “new world order,” a.k.a. “Open Society,” that the Destroyers of independent nation-states have long yearned and aimed and planned for.   New York's handgun regime is where the Globalists/Marxists are focusing their energies. If they can defeat the Second Amendment there, they also defeat the power and authority of the U.S. Supreme Court. So, the puppet-masters have given their puppets, Kathy Hochul and the Democrat Party-controlled Legislature in Albany, their marching orders. The Amendments to New York's handgun law are no less draconian than what stood before. The New York Government assumes that many people who had hoped to obtain an unrestricted handgun carry license easily, Post-Bruen, now realizing the hopelessness of the task, will simply capitulate, surrender the effort to obtain one.And, as the Government has included, in the Amendments, many more restrictions pertaining to places where, henceforth, it will be unlawful for the holder of a valid unrestricted license to carry a handgun in public, that, too—the Government hopes—will dampen whatever residual desire a civilian citizen may have to carry a handgun for self-defense. Obtaining a coveted handgun license will be, at best, at long-last, nothing more than a Pyrrhic Victory—hardly worth the effort.And, so, a recalcitrant, intransigent New York Government pushes hard against those citizens who intend to exercise their Second Amendment right regardless of the obstacles the New York Government places in their path. This means citizens must continue to expend earnest effort filing more expensive, more lengthy, more time-consuming lawsuits against Hochul and her Government. And the Government knows that, given the nature of the legal process, and of the effort, and time, and money involved, all those factors work to the Government’s advantage—not that of the citizen.Hochul's message is clear: “the New York handgun regime is here to stay, and any person who doesn’t like New York’s handgun regime, better have a deep pocket to file another lawsuit like Bruen, and they better have the time and energy and will power to follow through on it. They will need it.”Or, in the alternative, Americans can simply leave New York. Kathy Hochul’s predecessor, Andrew Cuomo—creator of and champion of the notorious New York Safe Act of 2013—has made abundantly clear that members of the GOP who hold “extreme views,” in Cuomo’s mind, are persona non grata. As he says, “you don’t belong in New York.’” See article in New York Post.So, then what? “Just leave?” And to be sure, many American Patriots have left New York. They have also left Illinois and California. But many other Americans, true Patriots, too, have stayed and they intend to fight for their fundamental rights and liberties in their State, their home.After all, many good Americans were born and raised in New York, in Illinois, and in California. These Americans consider those States to be their home. And those States are their home. So, why, then, should they leave? Let the corrupters of those States, like Cuomo and Hochul, and DeBlasio and Eric Adams leave New York. Let corruptors like Pritzker and Lightfoot leave Illinois. Let corruptors like Newsome, and Garcetti, and Breed, and Schaaf leave California, as well they all should. But where do Americans go if the Neoliberal Globalists and Neo-Marxist cultists take over the entire Country—which is occurring apace? The Biden Administration allows CCP China and the Billionaire, Bill Gates, to buy up vast tracts of land—and to what end? The Administration uses tens of billions of American tax-dollars against the interests of Americans and politicizes Government departments, agencies, and bureaus for its own nefarious ends. The military and police are demoralized and weakened. Our founders are denigrated. Our monuments and statues are defaced, removed, and desecrated.    The Biden Administration has done much to destroy this Country’s economy, infrastructure, and its resources, and its military preparedness and prowess. That is its sole reason for being. It is the sole reason, money, and time, and effort, and massive corruption of the electoral process was expended in getting Donald Trump out and getting Joe Biden and legions of lackeys into positions of power that they may damage the Republic irreparably.It has all paid off for the Corruptors of the Country. The Nation’s vitality is on the wane. This is not due to accident or mere happenstance; nor can it be explained as a product of gross incompetence. It is intentional. It is all part of an elaborate, sophisticated plan; carefully conceived and orchestrated; and methodically carried out.Yet, there are limits to the harm a feeble-minded and physical wreck of a man can inflict on this Country even though Joe Biden is but a titular Chief Executive. But, if California’s Governor, Gavin Newsom, should run for President, and secure the Democrat Party’s nomination for President in 2024, and, horror of horrors, if he became the 47th U.S. President, what then becomes of the Country.? Newsom’s California will be replicated across the 50 States. Where might Americans run to, then? What State shall be able to operate—may operate—consistent with the Nation’s Constitution and Bill of Rights, once tyranny cements itself firmly in the Nation, and reigns unchallenged, supreme over Constitution, Nation, and People?For what Americans have experienced, especially, in the last 19 months, one must conclude the American Revolution of 1776 was less a hard-fought war, won, than it remains a war yet ongoing, with battles Americans must continue to fight against its own Federal and State Governments. For these Governments adamantly refuse to acknowledge and accept the sovereignty of the American people, as first conceptualized by the Framers of the U.S. Constitution and then as actualized through the fact of our Nation's well-armed citizenry. But can America's Patriots prevail against such powerful, malevolent, and tenacious forces that dare to suppress our Nation’s fundamental rights and liberties and to oppress our people until they capitulate—every one of us—to a world-wide feudalistic empire whose central offices one shall find in Brussels, Belgium?As we have seen, even simple recognition of the sacred natural law right of armed self-defense is not to be found everywhere in our Nation, but only in scattered spots here and there. A tyrannical Federal Government and several more tyrannical State Governments, blotting the National landscape, refuse to countenance such basic right—the cornerstone of our free Republic and of the sovereignty of the American people over Government. Our Constitution demands that Government pay homage to the will of the American people through recognition of the right of the people to keep and bear arms. No other Government on Earth allows such. Most other Governments mock the very idea of it. But not here. Yet, today, our Government, this Federal Government, and many State Governments and regional and municipal governments have become like so many others; corrupt, and jealous, and guarded of their powers: a blight on a Free Republic. These Governments demand the American people pay homage to them; not they to the American people!The forces that crush have made substantial inroads into achievement of their goal: the demoralizing, destabilizing, and dismantling of our free Republic. They have corrupted every institution of our Country. They have denigrated our history, heritage, culture, ethos, and Christian ethic. And, they are stripping our Nation of its strength, and will, and fortitude. NOTHING IS MORE CONSEQUENTIAL TO THE PRESERVATION OF OUR NATION AND THE WORLD THAN IMMEDIATE DE-ESCALATION OF TENSION BETWEEN THE UNITED STATES/NATO AND RUSSIA!

In the midst of the present crisis in Europe, some Americans do retain perspective.We, at the Arbalest Quarrel, a website started in 2014 to cut through the chatter, fluff, hyperbole, outright nonsense, and disingenuousness of the usual news coverage and of news commentary, see well that the present conflict between Russia and Ukraine didn’t start yesterday, but can be traced to many upheavals in the past: some quite recent, going back to 2014; some earlier, to the first years of the 21st Century; others going back thirty years, to the early 1990s; and some going back much further in time; a century ago, to the period of the first world war.A couple of things about Russia and Ukraine are clear:

  • Ukraine is a region that has always suffered political and social convulsions; and
  • Russia’s ties to and interests in Ukraine have been ever apparent, always unbroken, profoundly earnest and acute, and inherently inextricable.

Russia’s incursion into Crimea in 2014, and more recently a full-scale invasion of Ukraine in 2022, is the direct result of conscious decisions of political leaders in Ukraine and Brussels, and of the United States as well.Those decisions resulted in a sequence of events, some planned for and anticipated; others not.Mishaps arose from those decisions; some not envisioned perhaps, but, as they materialized, definitely not wanted.The oratory of politicians, echoed in many major news organs of late, casts the present conflict, as it casts all conflicts, in overly simplistic, deceptive Manichean terms: A battle between good and evil.Unfortunately, many Americans fall prey to Manichaeism, having been psychologically conditioned to do so.Through seductive messaging, selective dissemination of information, and carefully crafted and tempered narratives, many Americans acquiesce to policies that have a deep, negative, long-term effect on their lives, and, by extension, on the lives of the rest of us who are not so easily prone to psychic manipulation.This is nothing new. Many members of the public have previously succumbed to such deceptive messaging of Government leaders and its echo chamber: the legacy Press.Consider America’s misadventure in the Middle East.The consequences of the U.S.-Mideast conflict, at once familiar and disturbing, were predictable: destabilization of the region; disruption, displacement, and senseless loss of civilian life and of the life of our soldiers; the squandering of the Nation’s wealth and resources; not insignificant economic harm; and attendant weakening of our own national security.The same inevitability of outcomes due to geopolitical machinations of Brussels and the United States is apparent in the current situation in Ukraine.The Press bombards the public daily with talk and imagery of the brutishness of Vladimir Putin; of the valor of Volodymyr Zelensky; of the heroic struggle of the Ukrainian people against the onslaught of Russian military; and of the coming oppression of the Ukrainian people under Putin/Russian rule.But little if any mention is made of the political interests of and plight of ethnic Russians in Ukraine, who represent a substantial minority of the population. And no mention is made of political and social upheaval that has plagued Ukraine in the last twenty or thirty years, or of Russia’s close political ties to the Country during that same period, and well before.And there is no mention of Brussel’s own expansionism eastward and of the concomitant impact on Putin’s expansionist impulses westward, driven in part no doubt by not unreasonable concerns over attenuation of Russia’s territorial security interests.Yet, the Biden Administration and the Press analogize this conflict simplistically and insufferably to a schoolroom situation, describing it in sharp dualistic terms of a “bad guy,” Russia, who bullies a weak, innocent, “good guy,” Ukraine. In doing this, the Administration and the Press treat the public like kindergarteners or as outright idiots.Consider Kamala Harris explanation of the Ukrainian crisis:“So Ukraine is a country in Europe. It exists next to another country called Russia. Russia is a bigger country. Russia is a powerful country. Russia decided to invade a smaller country called Ukraine. So, basically, that’s wrong.” ~ from theDaily Wire” To whom is Harris addressing this polemic? One might reasonably wonder, ponder, and posit, and ask: “who, really, should wear the ‘dunce cap?’”Is Harris behaving deliberately condescendingly? Or, is she simply a moron, a person who has little if any comprehension and appreciation of world affairs and of European history, and discloses that fact painfully, if unintentionally?But the Press echoes the same frivolous, vacuous message; vociferously, stridently, and inelegantly, with each passing day.Because of this simplistic, silly messaging, many Americans—all too many, who do little reflection—have once again acquiesced to the seductive call: to protect Ukrainian people who yearn for democracy against an evil oppressor, Russia. That, anyway, is the message. That is what Americans are told, and it has had the desired effect.Americans inculcate the meme that Russia and Putin are evil, and that, apparently, is all they need to know about Russia. And the expression, ‘democracy,’ overused in discourse and never defined by either the Press or Government officials, has lost whatever import and purport it once had. The expression has devolved into banality.But to the matter at hand: to what end is the United States called upon to render aid to Ukraine? How far is American assistance to Ukraine, expected to go? And most importantly, how does Russia perceive the United States Government’s insertion into Ukrainian-Russian affairs and what will Russia’s response to America be?Somewhere in the American psyche, there is a justifiable wariness, despite the constant drumbeat by the Press and by some in Congress who call for more action, including military action against Russia. It is fortunate that most Americans resist that. But some people do not.At least one person, the irrepressible Lindsey Graham, a Republican U.S. Senator no less, has called for Putin’s assassination. That absurd, reprehensible remark alludes unmistakably to a call for “regime change.” And what, after all, is this thing, “regime change?” It is a bit of American Governmental argot; an utterance at once peculiar, presumptuous, loathsome, and anachronistic.  Not to be outdone by Graham, the obsequious and droll GOP Representative Adam Kinzinger has called for a U.S. enforced a no-fly zone over Ukraine. He goes on to explain that no one should worry, that this does not portend incursion of American troops in Russia. Oh, really? Is not the call for a U.S.-enforced no-fly zone over Ukraine a transparently blatant threat and challenge directed to Russia?If the Biden Administration were, in fact, to institute such a U.S. enforced no-fly zone in a Russian military zone of operation, i.e., Ukraine, the mere issuance of the order, whether acted upon or not, would amount to a declaration of war by the U.S. against Russia. That isn’t supposition. That is a fact.Such statements by Graham and Kinzinger are both unconscionable and moronic. How might Putin react to them, coming from members of the United States Congress?So absurd are they, one could only hope that Putin would be amused rather than enraged by them, delivered as they are by a couple of buffoons who would do well to perform where they can do no harm: in a circus, perhaps, or in an asylum for the criminally insane, but not in the halls of the U.S. Congress.Fortunately, the Biden Administration isn’t taking advice from either Graham or Kinzinger, and the Administration absolutely should not.Yet, the Biden Administration should be forceful in pointing out the need for forbearance by both members of Congress and the Press in reining in their strident calls for vengeance against Russia. The Administration has not done that. Remarks from his communications’ people to date are dry, laconic, perfunctory.Russia cannot and should not be likened to a Country in the Middle East or to one in Africa or to one in South America; nor, to any other Country in the world, apart from CCP China.Russia, like the U.S. and China, has a massive nuclear arsenal. And Putin is not one to bluff. He is prepared to use it.The present crisis is really one that should be allowed to play out between Russia and Ukraine. But America’s blatant insinuation of itself into this drama has grave ramifications and portents we should not ignore.There are two crises playing out today. One is between Russia and Ukraine. That crisis is overt—war. Everyone knows that.But there is another crisis. This other one is tacit. It is one that ought to be of much greater concern to the American people and to the world. A latent crisis between two superpowers, Russia and the U.S., is where serious tension rests. That is where the focus should be directed and concerted efforts to reduce tension should be made.CCP China, which will be venturing into Taiwan—that is a foregone conclusion—is watching closely the U.S. Government’s reaction to the present crisis unfolding in Europe. The American public, though is not; too caught up as it is, attending to irrelevant rhetorical flourishes, pontifications, fallacious moralistic polemics, and irreverent ramblings from the Press, social media, cable and broadcast news and from Congress—some involving Russia and Ukraine, and others relegated to superficial asides, boiled down to one imbecilic bromide, the new dogma of the Neo-Marxist movement in America: “Diversity, Equity, and Inclusion.”This dogma, utilized by masters of brainwashing, originated in United Nations’ pacts, treaties, and position papers, where it is found, albeit with some effort, buried here and there, in seemingly erudite but deliberately abstruse, and muddled language, to hide ignoble intentions.Codified as a single imperative, “Diversity, Equity, and Inclusion,” persistently relentlessly repeated, it is a mantra designed to rot out the brain, down to the core of one’s being; infecting every institution of America; permeating every facet and layer of American society.This mantra, a thing designed to induce a trance in every American, is also a policy directive, worming its way into every policy aim of the Biden Administration. The infusion of “Diversity, Equity, and Inclusion,” into the psyche of people, superimposed over reason and sanity, heralds an improbable and absurd world reality.How, then, can Americans be expected to think clearly? Obviously, they cannot. Indoctrination teams train them to react, not to think. To perform like trained seals, not to reason, deduce, and conceptualize as human beings.Should Americans, then, be surprised that this Nation and the world fall perilously and precipitously close to nuclear war?The failure of the American people to appreciate that the world stands at the precipice of a nuclear conflagration is disheartening and disconcerting. Of what is America to gain from vacuous, political rhetoric and pseudo-moralistic sophistry pertaining to the fate of Ukraine in the face of incipient nuclear annihilation of the planet. Some people argue that Putin will push beyond the boundaries of Ukraine. But do we know that for certain? They conceive failure to stop Putin’s advance in Ukraine is a thing to be likened to Neville Chamberlain’s lame responses to Hitler’s advances in Europe. But there were no nuclear missiles in existence back in the 1930s. What should be of concern to us, at the moment, is an appreciation of the nuclear arsenals present in Russia and the United States. And we should be mindful of Russia’s historical ties to Ukraine. Ukraine isn’t the place for either the United States or NATO to establish a red line against Russian military advancement. Russia fears justifiable containment fears by the EU, NATO, and the United States. It doesn’t want the EU or NATO on its doorstep anymore than the United States wanted or would permit the Soviet Union on its doorstep, in Cuba.The use of even one tactical nuclear bomb in Ukraine or any instance of, or perception of, direct U.S. military involvement in Ukraine against Russia on behalf of Ukraine, will lead inevitably, irrevocably to global thermonuclear war. That brute and dire fact should not be lost on anyone.Armed conflict is messy. Anything can happen. There are too many variables. Even a computer algorithm cannot catalog them all or decipher the myriad patterns at play. History tells us that war gets out of hand and messy very quickly, tactically and strategically. And, both the war and America’s conduct in it should give one pause.  On the front page of The New York Times, Sunday, March 6, 2022, a reporter writes,“President Vladimir V. Putin warned on Saturday that crippling economic sanctions imposed by the West were ‘akin to a declaration of war,’ as the Russian military pummeled civilian targets and continued shelling near the first protected routes intended to allow besieged Ukrainians to flee, apparently violating a cease-fire that had been agreed to only hours earlier.” So, here the New York Times acknowledges Russia’s warning to the U.S. and to the EU and NATO to stay clear of interfering with the conflict, but then the Times reverts to form with a rabble-rousing remark intended to incite hatred in the minds of America toward Russia, despite Putin’s clear warning.In the same article, the Times writes,“Mr. Putin, in his first extended remarks since the start of the war, threatened to fully absorb Ukraine, the former Soviet republic of nearly 44 million people that declared its independence 30 years ago.‘The current leadership needs to understand that if they continue doing what they are doing, they risk the future of Ukrainian statehood,’ he said. Mr. Putin added that Moscow would view any Western attempts to impose a no-fly zone over Ukraine as ‘participating in the armed conflict’ against Russia.As Mr. Putin doubled down on his threats against Ukraine and the West, Mr. Zelensky spoke with more than 300 members of the United States Congress on Saturday. He implored them to impose a no-fly zone and to send military jets to his country, according to lawmakers on the call.”The words, “current leadership” that Putin refers to may seem vague, but definitely includes Brussel’s EU, NATO, and the U.S. Government, and it doesn’t appear that they are listening.Concurrently with the posting of the Times article, Secretary of State Anthony Blinken informs the public, as reported in the Daily Mail that,“Ukraine's government has a contingency plan in place if President Volodymyr Zelensky is killed during the Russian invasion, US Secretary of State Antony Blinken revealed on Sunday. Zelensky survived three assassination attempts by Russian-backed groups just this week, the Times reported on Friday. During an interview with CBS News' Face the Nation on Sunday, Blinken was asked if Russian leader Vladimir Putin would face 'consequences' for Zelensky's murder?’ host Margaret Brennan added.Blinken first praised Zelensky and other Kyiv officials as ‘the embodiment of this incredibly brave Ukrainian people.'‘The Ukrainians have plans in place—that I’m not going to talk about or get into any details on—to make sure that there is what we would call ‘continuity of government’ one way or another. And let me leave it at that,’ he answered.”  Blinken’s use of the phrase, continuity of government’ is mystifying and troubling in two respects.First, Blinken is hinting that the United States, EU, and NATO will not permit Putin to take control of Ukraine, even as it is eminently clear that Putin intends to do just that. So, there it is, a bright red line. The U.S./EU/NATO intends to clash head-on with Russia, over Ukraine even though Ukraine is not a member of either the EU or NATO, and notwithstanding that Ukraine is of no practical security concern for the United States and never was.Second, the expression, ‘continuity of government’ is an expression utilized by the U.S. Government in connection with imminent catastrophe, primarily, nuclear war. One official White House Government website is devoted to just that subject, with the specific heading “Continuity of Government.” In pertinent part, the website lays out that:“Since the days of the Cold War, the United States has had a plan in place to continue the operation of the government following a catastrophic attack on the nation’s capital. The 2007 ‘National Security Presidential Directive 51’ directs the geographic dispersion of leadership, staff, and infrastructure in order to maintain the functions of the United States Government in the event the nation’s capital is “decapitated” by a terrorist attack.Buried deep within the 102-page National Continuity Plan is the strategy for the mass evacuation and relocation of every federal government agency including The White House and the military in response to an exceptional catastrophic event within the National Capital Region. Each agency is required to have a detailed Continuity of Operations Plan (COOP) in place.Following a catastrophic national emergency, the President, or his successor can authorize the establishment of a temporary ‘Shadow government’ to maintain control of the essential functions of the Federal Government. President Bush activated the shadow government on September 11, 2001, shortly after the second attack on the World Trade Center.Every federal agency has designated key individuals to be part of an ‘Emergency Relocation Group’. These ERGs are assigned to an alternate secure location on a rotating basis and are ready to take over the duty of supporting the National Essential Functions of this nation in an emergency.”Most unsettling, issuance of the “Continuity of Government” order includes Supplanting the United States Constitutionand by logical implication, that means suspension of fundamental rights, including the most important natural law right of all, “the right of the people to keep and bear arms.”On reflection, one can see the puppetmasters, who control the Biden Administration, utilizing both the Ukraine crisis and the Freedom Convoy, making its way to D.C., as pretexts to invoke “COG” here at home. If that should occur, the American people will come to understand—must come to the realization, horrible and ugly, but indisputable as it is—that they have lost their Country; that Joe Biden is nothing more than, and never was anything more than, the titular head of a Government.This senile, abjectly corrupt “President of the United States.” He serves as a convenient placeholder and caretaker for the Nation. That is all he is and ever was: merely the custodian for a Nation that no longer belongs to the American people; a Nation no longer deemed to be a free Constitutional Republic.The western Globalists who control Brussels and NATO intend to supplant the sovereignty of the American people over the Federal Government, along with the overt de facto dissolution of the United States as an independent sovereign Nation-State. It exists solely to keep the current system in place, regardless of the cost [and it includes “Main Core”] A database of Americans, who, often for the slightest and most trivial reason, are considered unfriendly, and who, in a time of panic might be incarcerated. The database can identify and locate perceived ‘enemies of the state’ almost instantaneously. Secretary of State Blinken’s use of the phrase ‘Continuity of Government’ (COG) isn’t accidental. Even as Blinken uses that phrase in connection with Ukraine, the import of his remarks implicates the United States as well, for U.S./NATO confrontation with Russia is implicit in his remarks.The similarity of the Ukrainian-Russian crisis of 2022 to the Cuban-Missile crisis of 1962 is clear and categorical and ought not to be casually dismissed or cavalierly denied.But, for that one very public and very brief episode, the world stood at the brink of nuclear annihilation. Never since have Russia, China, or the U.S. confronted each other militarily. Military confrontation and challenges were conducted obliquely through minor proxies only, and for good reason. Dire outcomes were to be avoided and they were avoided. This was understood by all three major nuclear powers.If the American Press ever juxtaposes the 1962 Cuban-missile crisis with the 2022 Ukrainian crisis, we have yet to see it, and why is that? Only Russia has done so and, although the words of Russia’s deputy foreign minister were measured, the message conveyed by those words was clear and unequivocal and clearly directed to the United States Government.“Russia’s deputy foreign minister has compared Moscow’s standoff with the West over a possible invasion of Ukraine to the Cuban Missile Crisis, the tense 1962 confrontation between the US and the Soviet Union that led the world to the brink of nuclear war.Asked if he was exaggerating by comparing the Ukraine situation to the stalemate over the deployment of Soviet missiles in Cuba, Sergei Ryabkov said, ‘No, not too much,’ Russian media reported Monday.” ~ from the New York Post.And Vladimir Putin himself has purportedly said words to the effect that “a world without Russia would be no world at all.” The language might be cryptic. Its import is not.Whatever political, geopolitical, or economic interest the EU or the U.S. may have or think it has in Ukraine, nothing—absolutely nothing—is more consequential to the preservation of this Nation and the world than immediate de-escalation of tension between the U.S./NATO/EU and Russia.We do not see this happening, but it should; indeed, it must.If there are back channels between the U.S. Government and Russia, the public should gain some intimation of this; some assurance that the United States and Russia are in constant communication. But it is apparent the two are not. The U.S. and NATO intend to repel Russia from Ukraine. And Russia intends to press forward, claiming Ukraine as Russian territory or, at least, as a Russian-controlled region/orbit that serves as a buffer to inhibit EU expansion into Eastern Europe. Both the U.S./NATO alliance and Russia are headed on a collision course.The controlling issue in Ukraine is one of power and who controls the landmass of Ukraine.Given the stakes involved—the possibility of a nuclear conflagration—one must infer this has nothing to do with “democracy” and the sovereign independence of Ukraine. The Ukrainian people, and Zelensky, too, are nothing more than pawns. Their welfare is only a pretext for U.S./NATO/EU expansionism in the East. The two mighty powers, the U.S./NATO/EU on the one hand and Russia on the other are in a contest for control over Eastern Europe. It is anyone’s guess where CCP China stands in relation to this.Under Trump’s tutelage, it is unlikely Russia would have ventured into Ukraine. And if it had done so, Trump would have let the American public and, hence, the world know, and in no uncertain terms, that there would be no military confrontation between Russia and the U.S. over the fate of Ukraine—ever.  Trump sought to reconfirm and cement the United States standing as a true independent, sovereign Nation-State, in a world controlled by powerful, wealthy Neo-Globalist/Neo-Marxist elites whose aim is the dissolution of all western nation-states. They seek no less than the destruction of the very concept of ‘citizenship’ and of the concept of independent sovereign nation-state construct.The end goal of these secretive global “elites” is to see the establishment of a universal, transnational, multicultural, neo-feudalist corporate/financial/political/social empire, sans all geographical boundaries.Trump sought to spare the Nation from that fate. But Trump is no longer President of the United States. Powerful interests have seen to that. This Nation now has Joe Biden; a mentally weak, effete, ineffectual leader, if one can use the descriptor ‘leader’ in any meaningful sense. And the absence of Trump and the ensconcing of Biden into the Executive Branch of Government as titular head of the Nation has made all the difference. The fate of the Country is now in the hands of powerful interests who intend to destroy it.Whatever is going on behind the scenes, Joe Biden is the face of America projected to the world. And, to a lesser extent, his understudy, Kamala Harris, is also the face of America projected to the world.But what it is that is projected does not warrant respect nor engender confidence.Such things as strength, reason, stability, and integrity are sorely lacking here. And that noticeable lack justifiably frightens at least some of us and does so on many levels. NYPD OFFICER SHOOTINGS DRAW ATTENTION TO MAYOR ERIC ADAMS’ PLANS TO MAKE NYC SAFE: WHAT WILL HE DO?

Five NYPD officers have been shot in the line of duty, only three weeks into the New Year in Eric Adams’ reign as New York City Mayor.Most recently, on January 21, 2022, a psychopath and recidivist criminal with multiple violent felony arrests in New York and other States, Lashawn McNeil, 47, on probation, shot two police officers in New York City. See New York Post article.Officer Jason Rivera, 22, died in the line of duty, and his partner, Officer Wilbert Mora, 27, is clinging to life. The officers had answered a call involving a domestic situation in Harlem.The wife of the slain officer posted a moving tribute to her husband. The killer also shot and wounded a third officer, who returned fire, hitting McNeil in the head and arm. The killer is in critical condition as of Saturday morning. See report in The New York Times.A helluva guy, isn’t he? Let’s wish him well. Maybe the City should erect a statue to him, just like the statue it erected to George Floyd, in Brooklyn—at the same time the City removed the statue of Teddy Roosevelt.George Floyd was a drug addict and small-time crook—another character worth emulating.Just think: If Floyd had not attempted to pass a counterfeit bill off on a grocery store clerk, he would still be alive. But, then, the Neo-Marxist Democrat Party would’ve had to bide its time, awaiting some other pretext to speed the destabilization of society. House Speaker Nancy Pelosi makes that point clear, for which her own cohorts slammed her—apparently for being too straightforward and literal.

Neo-Marxists retain a nice, firm stranglehold on the City, even after one of their own—Bill de Blasio—has packed up his bags and departed from Gracie Mansion.The new Mayor, Eric Adams, had once served as an NYPD officer, retiring as a Captain.Unlike de Blasio, Eric Adams isn’t a rabid Communist but he is still subject to manipulation by those elements that helped get him elected and who seek the destruction of the City and the Country.This is clear enough from Adams’ own words, following the recent shooting of those two young police officers.And what did NYPD Captain Adams—now NYC Mayor—say to the City and the Country after the most recent shootings? Just this——“ ‘The police department is doing their job taking thousands of guns off the streets, yet each time you take a gun off, there’s a constant flow of new guns coming here. . . .‘And if we don’t coordinate to go after those gun dealers that are supplying large cities in America such as New York, we are losing the battle, and the federal government must step in and play a role in doing so.‘We need Washington to join us and act now to stop the flow of guns in New York City and cities like New York.’” See NY Post article.Later, Adams told Dana Bash, host on ABC’s Good Morning America:“‘We are able to stop terrorism in this city when state, federal and local law enforcement agencies shared information. . . .‘This is a sea of crime that has been fed by many rivers. . . . We have to dam those rivers.’” See report in NY Daily News.Honestly, is this what the City and the Country want or need to hear from the Mayor? Does the City and Country need to hear seemingly glowing, but vague and bland, or tiresome and nonsensical rhetoric, of Anti-Second Amendment zealots who wish to distract and deflect attention away from themselves and from a failed Criminal Justice System they, themselves, coldly, callously, calculatedly thrust on America?Obviously, the Neo-Marxist/Neoliberal Globalist puppet-masters had scripted Eric Adams’ words for him. And Adams dutifully regurgitated them. The words were contrived; all pretense. His intent was to keep New Yorkers in a perpetual state of passivity, apathy, and mental darkness.If Adams had truly sought to come across as a transformative figure, rather than as a carbon copy of the previous inept, yet smug de Blasio, he might have delivered something to stir the passions; to shake the public from its stupor and naivety. Adams might have said something like the following——

  • The creation of police intelligence units and quick reaction forces to target organized crime, criminal gangs, and sociopaths that commit violent crimes against police officers and against innocent civilians;
  • Encouraging City’s prosecutors to bring criminal charges against all violent offenders and to seek incarceration and, for repeat offenders, lengthy prison sentences;
  • Encouraging all Branches of the City Government to swiftly draw up concrete, comprehensive, and robust plans to secure the City from the violence that has plagued it for so many years under the previous Administration;
  • The Creation of task forces, mobilizing business and community leaders to assist my Office in developing zero-tolerance policies toward crime, vagrancy, and random violent acts committed by criminals, sociopaths, and psychotics against innocent citizens;
  • The Complete overhaul of the New York City Licensing Division concerning the issuance of firearms and handguns licenses for retired police officers, licensed security guard companies, and civilians.

As a former police officer, I am able to carry a gun. But that doesn’t make me special. I believe all responsible, law-abiding citizens of New York City, no less than I, should be able to carry a handgun for self-defense. That is their fundamental right. That is why I am undertaking a complete overhaul of the New York City Licensing Division.During my campaign for Mayor, I was asked whether, as a former police officer, I would carry a firearm if I became Mayor. I answered, ‘Yes I will, number one. . . . ‘And number two, I won’t have a security detail. If the city is safe, the mayor shouldn’t have a security detail with him. Alas, in his public remarks Mayor Adams didn't say anything to suggest a sea-change from the prior disastrous Administration.During his conversation on ABCs Good Morning America, Mayor Adams did mention he will be rolling out a plan this week to take on the “gun violence.”We can’t know what that plan entails. We would hope whatever it is, it will include our aforesaid recommendations. But we have our doubts.Our concern is that, by Eric Adams’ use of the Neo-Marxists’ buzz-phrase, ‘gun violence,’ and by tying that phrase in with ‘[domestic] terrorism,’ and by constantly exclaiming and reiterating that “the federal government needs to step in and play a role,” Eric Adams is playing directly to the Harris-Biden Administration’s goal of Federal Government intrusion on State’s rights in violation of the Tenth Amendment and on the American peoples’ rights under both the Ninth and Tenth Amendments.The ball is now in your court, Mr. Mayor. We pray to God, you do the right thing for the people of New York City.As the Mayor of a major, prominent American City, what you do will set an example for good or ill not only for New York City but for the Country as a whole. You can kowtow to a rogue Federal Government or you can defend the Nation's Bill of Rights. But don't think for one moment you can play both ends against the middle. The propagandists for the Democrat Party-controlled Government are nothing if not expert in the art of subterfuge, deflection, artifice, and duplicity. Turning the Bill of Rights on its head, they claim the Country will be better off once the American people just accept constraints on the exercise of their fundamental rights and liberties.But for whom would the Country be better off: for the American people or for the Neoliberal Globalists, along with their cousin Marxists, who intend to dismantle a free Constitutional Republic and merge the skeletal remains of the United States into something truly obscene: a transnational new governmental world order akin to the European Union?Already Biden has made overtures to Brussels, resurrecting the Transatlantic Trade and Investment Partnership or “T-TIP,” an arrangement that had stalled under the Trump Administration as did the Trans-Pacific Partnership or TPP.The true, if unstated, purpose of the G-7 Summit was to reassure Brussels that the U.S. was back on track to complete the agenda commenced in earnest thirty years ago—an agenda that had been making substantial headway under Obama, and that would continue under Hillary Clinton. But that agenda came to a screeching halt when Trump was elected U.S. President, to the surprise and shock and consternation of Neoliberal Globalists and Marxists both inside the Country and outside it, and no less to the chagrin of China, as well.But with the mentally debilitated, and easily manipulated Joe Biden firmly ensconced in the Oval Office, the Globalist and Marxist agenda could get back on track. The EU would get what it wants from the U.S.; China would get what it wants from the U.S.; even Russia got what it wanted. And who was left out of the mix? The American people, of course.But then, the Harris-Biden Administration and their cohorts in the Democrat Party controlled Congress, together with the seditious Press and social media and information technology titans haven’t bothered to ask the American people for their perspective on any of this. They really don’t care. They have effectively shunted Trump aside and they are treating tens of millions of American dissenters as potential “Domestic Terrorists” who refuse to go along with the game plan. The Globalists and Marxists will suffer no dissident thought or action. They are intent on stamping out all dissent. And this portends something serious on the horizon for the well-being of the Country and for the well-being of the American people.

Never before in American History has the Federal Government professed to declare war on its own citizens. In that regard, theNational Strategy for Countering Domestic Terrorismgoes much further than even the infamousU.S. Patriot Act, in presenting a direct threat to an American citizen's fundamental Rights and Liberties. In the broadest sense, a “Domestic Terrorist” is any American who professes disagreement with the Globalist/Marxist agenda.

ATTEMPTS AT OBFUSCATION DO NOT DISGUISE THE FACT THAT “DOMESTIC TERRORIST” REFERS TO ALL AMERICANS WHO ACTIVELY DISAGREE WITH AND WHO DISSENT FROM THE HARRIS-BIDEN AGENDA.

The expression “Domestic Terrorist” drags in a sizable portion of the American citizenry, at least a third of the Country, that cherishes the Nation's founding, formative Documents—the Declaration of Independence, the Constitution’s Articles, and the Bill of Rights—and takes them at face value, in accordance with the plain meaning of the language therein.And, what do these Documents proclaim and prescribe? They proclaim and prescribe the preeminence of liberty and personal autonomy and of the existence of natural, God-given rights that exist intrinsically in each person; rights that precede the formation of nations and of governments and make clear that the American people, themselves, and not the Government they happen to form, are the Sole Sovereign of their Nation, and that they alone have the God-given right to control their own destiny.This presents a conundrum for the Harris-Biden Administration, which is to say, a profound dilemma for those secretive, powerful insiders who are orchestrating and choreographing the Administration’s every move.One thing is clear: Those elements presently in control of the reins of the Federal Government do not perceive themselves as servants of the people but, rather, as master over them.The Harris-Biden Administration, the Democrat Party controlled Congress, the Bureaucratic Deep State, the Legacy Press, and the major social media and technology monopolies have dismissed the founding, formative documents of our Country, out-of-hand, and, in so doing, have effectively declared war on the American people.But, a sizable chunk of the American people, though, cherish and extol the tenets, principles, and precepts contained in the Nation’s sacred Documents. It would only be a matter of time. Only the presence of an armed citizenry could prevent this from happening, as the Founding Fathers well knew; hence the reason for the codification of the right of the people to keep and bear arms in an Amendment to the Constitution.It should come as no surprise to any American that the Destroyers of a Free Constitutional Republic would therefore mount a furious assault on the sacred right of the people to keep and bear arms.Not since the Nation’s inception in 1776, have the Obstructors of the Country come so close transforming it from a free Republic into an Authoritarian State—made all the easier through the use of information technology: technology that is capable of exerting vast control over content creation and dissemination of information, and the censure of it; technology that makes possible, the surreptitious, collection of private information and omnipresent surveillance of the Nation’s citizenry.The pillar of free speech, codified in the First Amendment and the freedom from unreasonable searches and seizures, codified in the Fourth, are both suffering slow strangulation as a result of the application of technology on a massive scale.The public has little to say about the application of, and has even less control over, technological advances that allow Government to nullify the unreasonable searches and seizures clause of the Fourth Amendment.And powerful Liberal Progressive and Marxist interests in the Federal Government flagrantly violate the First Amendment’s freedom of speech clause, operating through major social media monopolies, that share Progressive Left and Marxist sympathies and goals. The result is a blatant, shameless, unethical, illegal censure of speech.These elements in Government and business, operating in concert, have been successful at constraining public discourse, in recent years, to an extent never before countenanced. And they intend to upend this Nation’s Constitutional Republic now and for all time.Concomitant with censure of speech, and contrary to the dictates of the First Amendment, destructive forces in Government and in the technology monopolies have unleashed a campaign of propaganda to turn American against American and to indoctrinate children and adult alike. No institution is free from the onslaught; not even the military.

WITH FREEDOM FROM UNREASONABLE SEARCHES AND SEIZURES ESSENTIALLY ERADICATED, AND FREEDOM OF SPEECH UNDER CONTINUOUS, RUINOUS, HARASSING ASSAULT, ONLY FREEDOM TO OWN AND POSSESS GUNS REMAINS, OBSTINATELY RESISTANT TO GOVERNMENT ATTEMPTS TO CONSTRAIN EXERCISE OF THE RIGHT.

Only the right of the people to keep and bear arms effectively resists systematic and debilitating attempts by Progressive and Marxist influences to annihilate the exercise of this fundamental Right. But why is that? The reasons are plain. First, Americans recognize that no other Right defines them or the Country they are sovereign masters of, as the Right to own and possess firearms. So, Americans furiously defend that Right—more so than any other. Second, firearms are after all tangible implements, not intangible, digital objects, like words. It is not so easy for Government to purloin away one’s firearms as they have purloined away Americans’ private conversations and private documents and as they have systematically whittled away at the right of free discourse and free association among Americans of like kind.It’s impossible to take physical control over a citizen’s firearms surreptitiously. A person either has possession of them or he does not. And he will not so easily part with them. This angers the would-be Destroyers of a free Constitutional Republic to no end.How does one effectively separate a person from his firearms without causing a bloodbath in the Nation? This isn’t simply a matter of academic exercise for the Destroyers of our Country. They are well aware that the presence of—the continued existence of—armed citizens poses a direct, imminent threat to the installment of a Marxist totalitarian State and submergence of the remains of a free Republic in a Globalist Marxist new world order. But they also know that any attempt at a wholesale round-up of firearms would result in revolt—that is to say, armed revolt!It follows that no compromise on the right of the people to keep and bear arms is logically sensical despite the remonstrations of “antigun” groups carping endlessly over the need for more “commonsense gun laws”—as if they mean only that and nothing more. The idea is absurd on its face. It is all mere rhetoric designed to deceive. Americans have had more than enough of this nonsense.The question is: Now that Americans know the extent to which a free Constitutional Republic is in the crosshairs for destruction, and that the Federal Government has essentially declared war on its own citizens' sacred Rights and Liberties, what are Americans going to do to safeguard their Bill of Rights and their sovereignty over Government?___________________________________

PART TWO

A TYRANNICAL GOVERNMENT CANNOT LONG CONTAIN OR CONSTRAIN AN ARMED CITIZENRY.

If the American people are well-armed, then they can effectively, successfully resist Governmental attempts to control thought and action; they can effectively resist concerted efforts by tyrants to subjugate them; and they will always resist such efforts. But, if the American people are disarmed, they are defenseless before both two-legged predators and a predatory, tyrannical Government. So, the American people must continue to be well-armed. It is that simple.Thus, among those Destructive forces—neoliberal Globalist and international Marxist elements—who strive for firm Government control over the citizenry, the Right of the people to keep and bear arms must not be merely constrained, exercise of the Right must be curtailed. But, because it is immensely difficult to curtail citizen ownership and possession of firearms outright, absent wholesale bloodshed, which is to be avoided, the liberal Progressive Left and Marxists have been forced to undercut the Right of the people to keep and bear arms through a gradual escalating legislative process.The Federal Government’s assault on the Second Amendment started in earnest almost ninety years ago, with the enactment of the National Firearms Act of 1934. As with all antigun legislation, the pretext for the enactment of the NFA was an attempt to prevent criminal gangs from engaging in shooting rampages with certain classes of weapons, primarily fully automatic weapons and so-called short-barreled shotguns and rifles. The impact this law had on crime reduction was and is negligible. Its greatest and gravest impact was on infringing law-abiding American citizens' right to possess those firearms.Apart from actions by several State Americans to continue to enact laws to restrict and constrain the exercise of the right to keep and bear arms, the public was provided with a respite from the enactment of wholesale restrictive Federal firearms legislation for a period of sixty years, when Congress enacted the Violent Crime Control and Law Enforcement Act of 1994. That Act contained a subsection titled innocuously, the “Public Safety and Recreational Firearms Use Protection Act” a.k.a. “Assault Weapons Ban, the latter descriptor of which is more accurate and to the point.Once again, the public was told that the purpose of an assault weapons Ban was directed to curbing violent crimes committed with a certain category of guns. It did no such thing. It was all a lie, having nothing to do with constraining criminal use of firearms.All the Act succeeded in doing and was designed to do was to target average, law-abiding Americans, not to reduce violent gun crime. The salient if tacit purpose of the Act was to ban lawful ownership and possession of a wide range of popular semiautomatic weapons in the hands of tens of millions of law-abiding Americans. The Act wasn’t designed to prevent gun crimes. And the banned firearms were not even utilized in the vast majority of gun crimes anyway.The law was set to expire ten years later, in 2004. It did expire and not surprisingly, it wasn’t renewed. The public wasn’t deceived and demanded access to semiautomatic firearms.Notwithstanding the expiration of the Assault Weapons Ban, that didn’t stop Anti-Second Amendment forces in Congress to try to enact new laws restricting Americans’ access to semiautomatic firearms. They were relentless in their pursuit to curtail the exercise of the right codified in the Second Amendment. And they continued their effort up to the present time. To date, all such attempts have failed, and that has frustrated the forces that seek to destroy this free Constitutional Republic and its sovereign people. It was therefore left to Anti-Second Amendment State Governments to fill the gap and States like New York and California did so, with relish.With the neoliberal Globalist Obama in the Oval Office, to be followed by Hillary Clinton, the Destroyers of an independent sovereign United States felt confident that they could gradually tighten the noose around the neck of the American people so that, by the time the citizenry realized they had lost their Nation, along with their Bill of Rights, it would be much too late for them to do anything about it.But Hillary Clinton didn’t make it into Office. Donald Trump did. And once the sobering reality of that had sunk in for the neoliberal Globalists and the Marxists, they no longer took for granted that they could work leisurely and quietly to reconfigure the institutions of the Nation; disregard the dictates of or redefine the meaning of the Constitution to suit their goals; and implement their plans for a takeover of the Country incrementally.The forces that crush entire nations went to work on our own; frenetically, ceaselessly, assiduously, to sabotage Trump’s policy initiatives; engaging in a virulent media campaign of vicious personal attacks on him, on his family, on campaign officials, and on Americans who voted for and who avidly supported him, who had realized the singular importance of the Trump initiatives and policy goals and promises in getting the Nation back on track to regain its historical roots and sensibilities. Yet, all the efforts to dislodge Trump from Office met with abject failure and Trump was successful in realizing many of his goals.The forces that crush entire nations couldn’t understand Trump’s emotional strength; his resourcefulness, his fortitude; his resilience. The more vociferous and vicious the attacks became, the more implacable did Trump become.The public saw that Trump’s “America First” domestic and foreign policies actually benefitted the American people, Americans of all races. Trump was primed to win a second term in Office.The neoliberal Globalists and international Marxists would have not of that. And they pulled out all the stops to prevent that from happening.So, as a last resort, the enemies of the American people, both within the Republic and outside it, including likely the CCP and the EU Government in Brussels, machinated and conspired to prevent Trump from serving a Second Term. And they succeeded. Now, with Trump out of the way, and with Bush-era Republicans or otherwise meek Republicans offering no meaningful, substantial resistance to the agenda of Marxist Democrats, those Congressional Democrats are wasting no time consolidating their power over the Country and over the American people, before the 2022 midterm elections.

DEMOCRATS' TEN-PART PROGRAM TO CONSOLIDATE POWER AND GAIN CONTROL OVER THE NATION AND ITS CITIZENS

The Democrats' program involves, one, systematically corralling the voices of tens of millions of Americans; two indoctrinating the public in the tenets of Collectivism; three, consolidating control over the military and police; four, continuing to create mass upheaval and volatility in society with the assistance of criminal gangs, and Marxist and Anarchist agitators; five, maintaining dossiers on every person residing in the United States; six, inducing fear in the minds of all Americans that Government may designate them as “Domestic Terrorists” and commence to hound and harass them; seven, asserting Government control over the operation of the entire electoral process in order to control the outcome of elections; eight, continuing, indefinitely, an open borders policy, allowing a continuous deluge of illegal alien migrants and murderous drug cartel gangs to invade our Country, thereby further disrupting society; nine, creating the conditions for hyper-inflation to proceed, to reduce the mass of America to abject penury; and, ten, curtailing exercise of the right of the people to keep and bear arms so as to preclude the ability of the American people to revolt successfully against the inception of tyranny.Concerning the last item of business, expect to see concerted efforts by the Harris-Biden Administration, to implement executive actions, albeit as a “temporary fix” to restrict the possession of semiautomatic weapons. One would think the publishers, editors, and reporters who work for the mainstream Press—all those who claim to prize and champion the principles of civil libertarianism—would have applauded efforts of the Republicans on the House Permanent Select Committee of Intelligence to bring, to the attention, of Americans the devious, insidious malfeasance of senior DOJ/FBI Officials, and that they would do so vociferously.  Not so! Instead, major news organizations like The New York Times remained, for several weeks, abjectly, painfully quiet, hoping the matter would just go away and that the public would lose interest. But the matter wouldn't go away. Not by a long shot! So, in recent days, when it was no longer possible for the mainstream Press to remain quiet, it entered the fray, but did so only to echo the sentiments of Congressional Democrats on the Committee.These Congressional Democrats not only condoned the malfeasance of top DOJ/FBI Officials, but actively encouraged it. You would think Congressional Democrats would work hand-in-hand with their Congressional Republican counterparts on the Committee to provide much needed oversight of DOJ and FBI abuses. After all, the purpose of the House Permanent Select Committee of Intelligence is to provide oversight of the powerful DOJ/FBI and of the vast intelligence apparatuses, consistent with the Committee's mandate as set forth on the Committee's website:The United States House Permanent Select Committee on Intelligence (HPSCI) is a committee of the United States House of Representatives, currently chaired by Congressman Devin Nunes (California). Created in 1977, HPSCI is charged with oversight of the United States Intelligence Community—which includes the intelligence and intelligence-related activities of the following seventeen elements of the U.S. Government—and the Military Intelligence Program. The key word here is "oversight." The job of the House Permanent Select Committee of Intelligence is to provide watchful care of singularly powerful, secretive federal Government departments, agencies, and bureaus on behalf of the American people. The Republicans on the House Intelligence Committee seek to perform their duty, while the Democrats who sit on the Committee, shirk that duty. Congressional Democrats should have supported their fellow Committee Members. Instead they castigate them, and, in so doing, have forsworn their duty as Committee members and as Representatives of the people.Congressional Democrats who sit on this powerful House Permanent Select Committee of Intelligence Committee, do not, apparently, recognize that their job is one of oversight, or maybe they have forgotten this, or otherwise they don't care, or, perhaps--worst of all--they have capitulated. This means they are taking their marching orders from the individuals in the Deep State and Shadow Government. They are, then, deliberately undermining the work of the House Permanent Select Committee of Intelligence to engage in a duplicitous, reprehensible attack on the United States President, Donald Trump. And that means they are engaging in an insidious, outrageous, reprehensible attack on the American electorate and on the United States Constitution. This is their ultimate betrayal. Adam Schiff (D-CA), the ranking Democratic member on the Committee and his ilk, including, most notoriously, Eric Swawell (D-CA), Schiff’s close compatriot on the House Intelligence Committee, have literally given the “Green Light” to those individuals who work in the DOJ/FBI who have abused their authority, who have betrayed their Oath, and who have betrayed this Nation and the American people. By facilitating wrongdoing in Government, Congressional Democrats who sit on the House Permanent Select Committee of Intelligence have conveyed the message to the DOJ/FBI and to those who work in the intelligence community that these people can do whatever they want; that Congressional Democrats, like Adam Schiff, Eric Swawell and others, will cover for them. Congressional Democrats have thus become mere toadies of senior Officials of the DOJ/FBI and of the vast intelligence apparatuses. They cloak abuse in Government, rather than bringing abuse to light, and, in masking serious abuse in Government, these Congressional Democrats compound malfeasance with malfeasance of their own.They are all mere toadies of the senior Officials of the DOJ/FBI and of the intelligence apparatuses. These toadies allow the hidden Deep State and Shadow Government, within the external Government we see, to exist and, in fact, to flourish. The Clintons and Barack Obama, along with Congressional Democrats, and several Republican Centrists, and the mainstream media, and their trans-nationalist, internationalist globalist billionaire benefactors, are enablers of the Deep State and of the Shadow Government and always have been. Even now, behind the scenes, they are all quietly, incessantly working to undercut the U.S. President. In so doing, they are working to undercut the will of the people; they are working to undercut the sovereignty and independence of the United States; they are working to undercut the supremacy of our Constitution and our system of laws; they are working to destroy the rights and liberties etched in stone in the Bill of Rights.Unchecked, abuse of power invariably continues unabated, and, in fact, worsens incrementally over time. Lack of Congressional oversight, coupled with a compliant, mainstream Press that operates merely as an echo chamber of and for an effete Congress encourages malfeasance in the Bureaucracy of the Federal Government. Lack of strong Congressional oversight allows senior Officials in the labyrinth of the Deep State and Shadow Government to operate with impunity. Congressional Republicans must protect President Trump so that the President may do the job the American electorate expects of him,  which is to strengthen this Country and revitalize it; to strengthen the rights and liberties of the American citizenry; to make clear to trans-nationalist, internationalist globalists that the United States belongs to the American citizenry, and to no one else; to make clear that Americans have a right to take pride in their history, in their core values, in their history, in their Christian heritage and that there is no reason to feel guilty about any of this. Of course, Congressional Democrats and the mainstream media want none of this. Their vision for this Country marks the end of it. They wish to turn this Country over to the weak, the effete, the effeminate--making it ripe for takeover. So it is that the American citizenry cannot depend on either Congressional Democrats or upon the mainstream Press to investigate and curb abuses and excesses in Government. Rather, these Congressional Democrats, on the one hand, and, on the other hand, the publishers, editors, reporters, news anchors and commentators of left-wing networks, namely and particularly, ABC, CBS, CNN, MSNBC, and even PBS, that comprise the bloated mainstream Press, are all complicit in hiding evidence of gross malfeasance in the Federal Government. But, they go further; much further. Congressional Democrats and the mainstream Press not only hide evidence of malfeasance in the high ranks of the DOJ and FBI, and in other Federal Government departments, bureaus, and agencies, they actively abet Federal Government malfeasance.The mainstream media, in particular—this Press that prides itself as the protector of liberty is anything but that. The mainstream Press has devolved into a mere mouthpiece for the machinery that comprises the Deep State and the Shadow Government. This mainstream Press is now merely an organ of propaganda. This Press does not strive to preserve the sacred rights and liberties of the American citizenry but, rather, works methodically, inexorably to undermine those rights and liberties—the very rights and liberties upon which a free Republic rests.The New York Times wasted little time and expended much effort in attacking the House Intelligence Committee “Nunez” Memo, devoting considerable newsprint in that effort, as is clear from a perusal of the Saturday, February 3, 2018 edition of the newspaper.On page A13 of the print edition of the newspaper, the Times published the entirety of the Nunez Memo, including the cover letter, authored by the President’s personal attorney Donald F. McGahn II. THE DISAMBIGUATION OF ‘TRUTH,’ ‘FACT,’ AND ‘OPINION’

Americans often hear the refrain that, “everyone is entitled to their own opinion, but they are not entitled to their own facts.” The quip, recited with some variation, is attributed to Senator Daniel Patrick Moynihan (D-NY). Senator Moynihan, who died in 2003, served in the U.S. Senate from January 1971 through January 2001, and served, as well, as an advisor to the Republican President, Richard M. Nixon.As with many quips, Moynihan’s, too, has become, through time, an ivy-covered adage—an adage that one is expected to accept on faith as a weighty, profound truth. That would explain its continuing popularity, especially among Congressional Democrats. They recite it to refute statements of Congressional Republicans or of the U.S. President, Donald Trump. Moynihan’s quip then serves as a convenient “sound bite,” a shorthand denunciation of any statement coming from a Congressional Republican or from the U.S. President that they happen to take exception with as if the falsehood of any statement coming from those that Democrats disagree with is so obvious that no evidence is required to support their denunciation of it.The problem is that “facts”—if there are such things at all—tend to be pliable, flexible things, no less so than opinions. Facts are represented colloquially as kinds of entities that are “out there” in the aether, and, so, do not emanate from or exist in a person. Supposedly, people make assertions about facts, and those assertions are either true or false, predicated on whether, according to a couple of epistemological theories, the assertions “cohere with” or “correspond to” particular “facts.” The presumption is, then, that facts are infallible as they do not rest on one’s belief or opinion about them. That is the point of Moynihan’s quip. The problem is that, if “facts” are “out there,” a person really cannot ever retrieve them, for a person can never pierce the veil of his or her own perceptions. Facts, if there are such things, are not, generally the sort of things we can get to. The best that can be hoped for is that corroborating evidence—which are really nothing more than beliefs and opinions ostensibly resting on another fact or set of facts, and so on ad infinitum—serves to establish the truth or falsity of a person’s statement and that, through such corroboration, a consensus is reached, at some point, among the language speakers of a given community, as to convincing truth or falsity of a given statement.Sometimes consensus is readily achieved. At other times it is not.Consider the statement, “Deputy Attorney General, Rod Rosenstein, appointed Robert Mueller as Special Counsel to investigate, among other things, ‘any links and/or coordination between the Russian Government and individuals associated with the campaign of Donald Trump.’” That is a statement, the truth or falsity of which is determinative to the extent the statement coheres with or corresponds to or correlates with or, let us say, “mirrors” a “fact” about the world—namely whether there exists a person named Rod Rosenstein, who is, at the moment at least, a Deputy Attorney General within the Department of Justice, and that he appointed a person, Robert S. Mueller III, as Special Counsel to head a team to investigate certain matters pertaining to the Presidential campaign of Donald Trump.We say the statement is true, if it is the case that the statement coheres with or corresponds with or--let us say--correlates with or mirrors a particular “fact” or "set of facts" about the world. Well, an astute person, who has been keeping abreast of news reports knows that Rod Rosenstein does exist and that he is the Deputy Attorney General and that he did appoint a person, Robert Mueller, as Special Counsel, and that Robert Mueller has been given his appointment and specific instructions through Order Number 3915-2017.  So, we would say that the statement is, first of all, the kind of thing that is a truth bearer--that is to say--it is the kind of thing that can be ascertained to be either true or false. Since the statement does correspond to or cohere with or mirror a particular set of facts about the world, we say that the statement is true, and there is certainly public consensus on that. So far, no problem. But ostensible matters of fact and statements purporting to be about matters of fact get interesting and out of whack very quickly.Consider, for example, the statement, “the Mueller appointment as Special Counsel was justified.”  In asserting a justification for something, one is moving away from statements about facts. One is moving away from descriptive statements or accounts about the world—statements subject to corroboration. We are, instead, making prescriptive statements about the way the world ought to be. Counterfactual statements, as the term, ‘counterfactual,’ suggests, do not purport to say anything about the world at all. This is where Moynihan’s quip loses efficacy and poignancy, where it loses steam. For, statements about the way the world ought to be do not lend themselves to corroboration. There is no readily obtainable fact or set of facts to turn to ascertain the truth or falsity of the statement.The problem is that politicians, as with most people, do not distinguish between descriptive accounts about the world--the way the word is--and prescriptive or normative assertions about the way the world  is supposed to or ought to be. They believe, wrongly, that descriptive statements about the way the world is and prescriptive or normative statements about the way the world ought to be or should be are both factual—subject to corroboration, verification in the world.The public begins to ask questions, for example: "was the appointment of a Special Counsel to investigate Donald Trump justified? If not, then what lay behind the appointment?" And, "if appointment of Special Counsel was justified, was Robert Mueller the best person for the job?" But, the answers obtained, and the conclusions drawn, are muddied through one’s personal biases and predilections—those things internal to the person. This is where truth or falsity of statements, grounded in  purported “facts,” becomes fuzzy.Now, going back to Moynihan’s clever remark, we find that a person who believes the quip has efficacy might say that there are indeed, "hard, cold concrete facts" “out there” concerning the appointment of Robert Mueller and concerning various other matters, interrelated, going all the way back to the FBI handling of the investigation of Hillary Clinton for serious crimes against the Nation and against the American people and that, once a person gets to the bottom of it all, the truth can be ascertained and sorted out because there is only one fact or set of facts in the world for each and every proposition about the world. Well, if one sets forth descriptive statements about these matters, then, there would reasonably be a consensus about them as this would simply amount to an exercise of lining up, one-by-one, each descriptive statement with a concrete "fact" existent in the world upon which the truth of the statement is based.But, sorting out the propositions—a very large number of them and associating each of them in a one-to-one correspondence with or coherence with a specific fact—is exceedingly difficult, no less so because the American citizenry doesn’t have and cannot gain access to all the underlying  information.Unfortunately, many politicians don’t want the American people to have access to the underlying information nor, for that matter, to any information about the inner workings of the Federal Government, upon which their lives may be deleteriously impacted because that would shed light on the machinations of senior officials in Government who have likely engaged in illegal actions. What are the illegal actions of these senior officials? Well, we suspect that they used the power of their Office to give Hillary Clinton an edge or boost against Trump in the run-up to the 2016 election, and we suspect that they have engaged in illegal actions to oust Donald Trump from Office upon his prevailing in the U.S. Presidential election against Clinton. Politicians give seemingly plausible reasons for precluding the average American citizen from gaining access to such information. They raise issues of national security. They talk about the need to protect confidential sources and to safeguard intelligence gathering methodology. Sometimes these seemingly plausible reasons are sound. Often, as in the matter of release of the House Intelligence Committee Memo, they are not. They are simply clichés offered up to hide the real reason for keeping the Memo hidden: to prevent the American citizenry from learning of illegal machinations behind the scene that upend the entire Democratic election process. They suggest that, due to Russian meddling, which they insist Americans  accept without proffering any proof to support the assertion, Clinton would have won the election--a conclusion that doesn't follow from the premise that the Russians did interfere with our elections, even if the underlying premise is true. But, that conclusion, apparently, provides the impetus for and drives the action on multiple fronts to oust Trump from Office. Now, one may demur, arguing that the assertions set forth in this article are themselves mere unsubstantiated opinion. But are they? Are they not declarative assertions that can be substantiated, through release of the House Intelligence Committee Memo? Surely, the truth--or falsity for that matter--of the assertions made here can be substantiated at least in part through release of the Memo. But, that isn't something the supporters of Clinton want, even if the public would finally be privy to the underlying basis for the Mueller investigation. No one on either of the political spectrum would refute that point, which explains why, on the one hand, Congressional Democrats and senior Officials of the DOJ and FBI, and those who supported Hillary Clinton's candidacy, among others, including publishers, editors and reporters of the mainstream media and left-wing news anchors and commentators, don't want the Memo released to the American public, and why, on the other hand, Congressional Republicans, and many rank and file FBI agents and rank and file DOJ attorneys, and American citizens who supported Trump, along with conservative news reporters and commentators do want the Memo released to the American public and unredacted.* They evidently know that the information set forth is true, and it is the truth that they cannot and will not abide. It is the truth that they are afraid of. For, it is the truth that illustrates for the American citizenry to see, indeed for the entire world to see--when that truth is held up to the light of day--that these individuals, these senior Officials of the FBI and DOJ, and these Congressional Democrats, such as Adam Schiff and Dianne Feinstein, are scoundrels, not deserving of respect of the people whom they claim to serve; whom they deign to serve, but whom they serve up as slaves to the lords whom they really serve--the internationalist, trans-nationalist globalist "elites" who seek to subordinate this Nation and its people to a new pan-world Order.If the Mueller investigation is a sham, then, presumptively, the motive behind the investigation operates, not to find evidence of wrong-doing on the part of Donald Trump or on the part of Trump Campaign Officials or members of Trump's Administration, but operates, rather, as a critical step leading up to impeachment. And, once again, no one would seriously contest the accuracy of that point either, which would explain why it is that, having failed to find evidence of a criminal conspiracy between anyone connected with Trump and the Russians--if ever there were grounds for surmising such conspiracy in the first place--Mueller and his team are not wrapping up the investigation but are exploring other avenues of investigation, namely obstruction of justice--to keep the sham going. Obstruction is, for Mueller and his team, a convenient "peg to hang a hat on," because "[i]n a broad sense, any offense negatively affecting government functions can be viewed as an obstruction against the administration of justice. For example, treason, sedition, perjury, bribery, escape, contempt, false personation, destruction of government property, and assault of a public official are crimes against the government. Moreover, as the number of governmental functions has increased throughout time, the number of statutory offenses penalizing obstructions of those functions likewise has increased. Many of these crimes have been clearly and distinctly set apart as separate offenses. . . ." "The Varying Parameters of Obstruction of Justice in American Criminal Law," 65 La. L. Rev. 49 (Fall 2004), by John F. Decker. Obstruction of Justice charges are, by their nature, open-ended matters--broad domains into which almost any wrongdoing or semblance of wrongdoing can be dropped. Of course if an obstruction of justice charge could ostensibly be lodged against Donald Trump or of any one or more people in his Campaign or in his Administration, one could certainly make the case that an obstruction of justice charge, among many others, could, reasonably, certainly, have been lodged against Hillary Clinton and against individuals who worked for her Campaign. And, if obstruction of justice charges were not lodged against Hillary Clinton and others who worked for or on behalf of her when, notwithstanding that all of the elements of multiple obstruction of justice charges were met, then why wasn't Clinton and any of her people charged with obstruction of justice? If those members of the FBI who were involved in the investigation of Hillary Clinton on multivarious federal charges did not bring charges against her specifically because they did not wish to disrupt her campaign for the U.S. Presidency, then, one might well ask whether those investigators of the FBI involved had not themselves obstructed justice. But, who would charge them? And, imagine for a moment that Hillary Clinton did prevail in the 2016 U.S. Presidential election against Donald Trump. Imagine a likely criminal occupying the highest Office in the Land. Imagine a system of laws in this Nation turned on its head. Imagine Harlequin Justice and a Harlequin U.S. President: Hillary Clinton. The conclusion we draw is that an attempted coup of our Constitutional Republic is underway. The contents of the House Intelligence Committee Memo will certainly lend credence to that conclusion. That is why there has been considerable push-back against release of the Memo to the public. The Conspirators don't want an accounting. They don't want a reckoning. Thus, they come up with specious reasons to waylay release of the Memo. What the American public is witness to is a deliberate and reprehensible attempt--assembled by actors in Congress, in the Federal Bureaucracy, and in the Mainstream Media, with likely assistance from Billionaire globalists both here at home and abroad to undermine the Trump Presidency.Representative Devin Nunes (R-CA), House Intelligence Committee Chairman, seeks to redress this horrific situation that bad actors have inflicted on our Country and continue to inflict on our County and that is why he ordered preparation of a Memorandum detailing DOJ and FBI surveillance abuse and misuse of the FISA Court by senior Officials of the DOJ and FBI. These abuses involve presenting the FISA Court with an application for issuance of a warrant to enable the FBI to conduct surveillance of American citizens. If the application were submitted with evil intent, with knowledge that the presenters had that the content of the application was patently false or that the content had not been corroborated for veracity and if those presenters of the FBI and DOJ represented to the FISA Court that the content of the application for a FISA warrant was true, then those presenters of the FBI and DOJ perpetrated a fraud on the Court. That is reprehensible. That is unforgivable. And that, apparently, is precisely what happened. That is what prompted Representative Nunes to order preparation of the Memo, for release to the American citizenry. The legal authority for him to do so is based on the Committee’s function and job:“The United States House Permanent Select Committee on Intelligence (HPSCI) is a committee of the United States House of Representatives, currently chaired by Congressman Devin Nunes (California). Created in 1977, HPSCI is charged with oversight of the United States Intelligence Community—which includes the intelligence and intelligence-related activities of the following seventeen elements of the U.S. Government—and the Military Intelligence Program.”The HPSCI is tasked with oversight of powerful institutions—seventeen institutions that, in a free Republic, cannot be trusted to police themselves. Representative Nunes became frustrated, and rightfully so, by DOJ and FBI recalcitrance in responding to Committee concerns.The DOJ and FBI must answer to the American people through their Representatives in Congress. Apparently, the DOJ and FBI don’t see it that way. Congressional Democrats, like Adam Schiff and Nancy Pelosi and Dianne Feinstein—who have been most vocal in their denunciation of the House Intelligence Committee Memo—don’t see it that way either. You would think that all members of Congress would be aghast at unethical conduct, arising to the level of crimes—serious crimes at that—that senior Officials of the DOJ and FBI, had likely committed against the Nation and against the American people. But, Representatives Schiff and Pelosi and Senator Feinstein don’t want the public to have access to the contents of the Memo. Apparently, neither does the mainstream media that has come out of the shadows itself on the topic, which it had previously ignored, and no longer can do so, and, so, reluctantly reports it.Why is it that Representatives Schiff and Pelosi, and Senator Feinstein don’t want the public to have access to the contents of the Memo? What is it that senior Officials and Congressional Democrats are fearful of? Are they afraid that the contents of the Memo do not correspond with or cohere with facts, as they claim, and that, the public therefore should not gain access to a document that portrays senior Officials of the DOJ and the FBI in a false light, damning them for illegal conduct these senior Officials of the DOJ and the FBI never engaged in? Or, rather, is it because these Senior Officials of the DOJ and FBI and these Congressional Democrats are afraid that the contents of the Memo do clearly correspond with or cohere with facts “in the world” and that the contents of the Memo do rightfully damn these individuals for betraying their Oath to uphold the U.S. Constitution. If the latter, then one need not wonder as to the concern of Congressional Democrats and the concern of high-ranking Officials in the Federal Bureaucracy over the contents of the Memo, and why it is they remonstrate against the Memo’s release. For, these holders of high rank in Government, who wield incredible power, and whom the public is expected to trust, and who are expected to utilize the power of their Office circumspectly, and whom, the public—so it is told—have the utmost integrity, would be exposed for the frauds that they are, and would, themselves, be investigated for crimes against this Nation and against the American people. Moreover, it is clear enough, although no one publicly acknowledges it, that, once President Trump does allow for the release of the House Intelligence Memo to the American public, there will be a ripple effect that calls into question the legitimacy of the entirety of the Mueller investigation. And, the ripple effect does not end there. The public will obtain an inkling as to depth of and complexity of the conspiracy against the U.S. President and, by extension, the depth of and complexity of the conspiracy against the American people. The American public will rightfully demand an accounting of these high-ranking Officials, including a demand for an accounting of Congressional Democrats who protect these Federal Bureaucrats who flagrantly violate the laws of the Land—senior police officials and senior attorneys, whom one would think would have the utmost respect for our laws, but who obviously don't.The reasons Congressional Democrats give for preventing release of the Memo to the American public cloaks a normative argument that is not subject to true/false verification. These Congressional Democrats and the senior Officials who both betray their Nation and its people have a vision for this Nation that cannot be reconciled with the vision that President Trump and much of the American citizenry have for this Country. These Congressional Democrats and senior Officials of the DOJ and FBI and many senior Officials of the Federal Bureaucracy wish to create a Nation that is subordinated to a new pan-World Order; a Nation with open borders; a Nation open to disparate multicultural influences; a Nation suffering the fragmenting of core values; a Nation witnessing the disassembling of fundamental rights and liberties; and a Nation that sees an expansion and consolidation of power in the Federal Government with ultimate transfer of power to international Governing bodies. Clearly, these senior Officials of the DOJ and FBI that wield incredible power have little regard for the American people. And, those members of Congress who protect and enable the  illegal conduct of these Officials are no better. Indeed, they are all complicit in the assault on our Constitution and complicit in the illegal effort to destroy the Trump Presidency. These Senior Officials of the DOJ and FBI feel they can spurn our laws because they presume they know what is in the best interests of the American people. They create ad hoc rules of behavior for themselves as they deem themselves to be superior to the public.  They demonstrate contempt for the citizenry. Their behavior amounts to crass, unabashed paternalism. The Founders of our Republic would be appalled. You should be appalled too. The American citizenry must demand an accounting. RELEASE THE MEMO: SENIOR DOJ AND FBI OFFICIALS LIKELY COMMITTED SERIOUS FEDERAL CRIMES IN THEIR UNLAWFUL ATTEMPT TO TAKE DOWN PRESIDENT TRUMP.

THE SWAMP MUST BE DRAINED; CONSPIRATORS’ HEADS MUST ROLL; THE GUILTY MUST BE HELD FULLY ACCOUNTABLE.

As intimated in the account of the contents of the House Intelligence Committee Memo that Representatives Jim Jordan (R-OH) and Matt Gaetz (R-FL) have alluded to on Fox News, it is not enough that Senior DOJ and FBI Officials, whose names appear in the House Intelligence Memo, simply lose their jobs (which would allow them to collect retirement benefits). The fact that DOJ and FBI senior officials like Peter Strzok, Andrew McCabe, Bruce Ohr, and undoubtedly many others, continue to hold onto jobs in the DOJ and FBI, is reason for consternation.Clearly, other senior Officials of the Deep State are protecting them. How high up the Government ladder does this insidious subterfuge extend? The President’s call to drain the swamp now takes on immediate and critical urgency.The “swamp” of the Federal Government is, it is now evident, more than mere metaphor—much more. The expression takes on literal meaning. Why are these senior DOJ and FBI officials still holding positions in the Federal Government? Why are they still receiving paychecks, courtesy of the American taxpayer? Why do they still hold top secret security clearances? These people and others should be fired immediately, and they should be investigated for serious crimes against this Nation and the American people. Why hasn’t Attorney General Jeff Sessions acted against these individuals? After all, Jeff Sessions holds the highest position in the Department of Justice? Why hasn’t Sessions cleaned house? Is he unable to do so, notwithstanding that he holds the top position in the DOJ? If that is the case, then, do high-ranking officials in the DOJ, and in the FBI, and in other Cabinet-level Departments, and in the Military, and in the Intelligence Community, and in Congress too, hold sway over the entirety of the Federal Government. If these high-ranking senior Officials, these Conspirators who have betrayed their oath of Office, who have betrayed the U.S. Constitution, who have betrayed this Nation, and who have betrayed the American people, do hold sway over the Federal Government, then, we must conclude that this Shadow Government—this Deep State within the Federal Government—these Conspirators hold sway over the American people as well. Has a coup d’état of the Government already taken place notwithstanding their failure to seat the shrew and puppet of the trans-nationalist, internationalist, globalist “elite,”—Hillary Clinton?If Attorney General Jeff Sessions does muster the strength to exercise the authority vested in him and hold to account those officials of the DOJ and FBI, who have betrayed this Nation, who have betrayed our Constitution, and who have betrayed the American people, then we should see investigations commencing at once. If the Attorney General does not have the courage to assert his authority, then he should resign; and, if Sessions does not voluntarily step down, then President Trump should demand his resignation, or otherwise, simply fire him, and appoint a person who has the stomach to clean house!In the interim, these Betrayers of our Nation, of our Nation’s Constitution, and of our Nation’s citizenry must be prevented from doing further harm to our Nation, to our Nation’s President, and to our Nation’s people. Accordingly:

  • THEIR EMPLOYMENT WITH THE DOJ OR FBI SHOULD BE TERMINATED AT ONCE!
  • THEIR SALARIES SHOULD BE SUSPENDED!
  • THEIR SECURITY CLEARANCES SHOULD BE REVOKED!
  • THEIR MISCONDUCT SHOULD BE THOROUGHLY INVESTIGATED!

Once evidence of the serious federal crimes--that these senior Officials of the DOJ and FBI committed and are even now still committing--has been systematically collected, collated, and analyzed by prosecutors—and it is certainly clear that a plethora of such evidence exists—then legal action must commence forthwith:

  • THESE BETRAYERS OF THE NATION SHOULD BE INDICTED!
  • THESE BETRAYERS OF THE NATION SHOULD THEN BE TRIED IN A COURT OF LAW FOR THEIR CRIMES!
  • IF CONVICTED, THESE BETRAYERS OF THE NATION SHOULD RECEIVE NO LENIENCY IN THE METING OUT OF THEIR SENTENCES.
  • AND, THESE BETRAYERS OF THE NATION SHOULD BE DENIED RECEIPT OF PENSIONS AND BENEFITS!

IF SENIOR OFFICIALS OF THE DOJ AND FBI HAVE COMMITTED SERIOUS FEDERAL CRIMES AGAINST THIS NATION, AGAINST THIS NATION’S CONSTITUTION, AND AGAINST THE AMERICAN PEOPLE, AS IS NOW MANIFEST AND CLEARLY CERTAIN, WHAT WOULD THE NATURE OF THOSE CRIMES BE? WE PERCEIVE AND ANTICIPATE THE FOLLOWING: CONSPIRACY; PERJURY; SUBORNATION OF PERJURY; DEPRIVATION OF RIGHTS UNDER COLOR OF LAW; AND OBSTRUCTION OF PROCEEDINGS BEFORE DEPARTMENTS, AGENCIES, AND COMMITTEES.

One serious crime falls under Title 19 of the United States Code: Crimes and Criminal Procedure, Part I, Crimes, Chapter 19, Conspiracy.19 USCS § 371 (Conspiracy to commit offense or to defraud the United States) sets forth in principal part:  If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both. A second serious federal crime falls under Chapter 79 of the United States Code. Chapter 79 of Title 18 of the United States Code. 18 USCS § 1621 (Perjury generally) sets forth in principal part: Whoever—(1)  having taken an oath before a competent tribunal, officer, or person, in any case in which a law of the United States authorizes an oath to be administered, that he will testify, declare, depose, or certify truly, or that any written testimony, declaration, deposition, or certificate by him subscribed, is true, willfully and contrary to such oath states or subscribes any material matter which he does not believe to be true; or(2)  in any declaration, certificate, verification, or statement under penalty of perjury as permitted under section 1746 of title 28, United States Code, willfully subscribes as true any material matter which he does not believe to be true;is guilty of perjury and shall, except as otherwise expressly provided by law, be fined under this title or imprisoned not more than five years, or both.Since the Fusion GPS Dossier is a lie, those DOJ Officials who presented it to the FISA Court, swearing to the authenticity of the contents have committed perjury before the Court; and, since they did this to secure a warrant from the FISA Court that would allow Special Counsel Mueller to undertake an investigation of Trump Campaign Officials, predicated on presumptive collusion between Russian officials and Trump, those DOJ Officials who lied before the FISA Court to affect or influence the FISA Court to issue a warrant have committed a third serious federal crime, that these senior Officials of the DOJ and FBI have likely committed is subornation of perjury.A third serious federal crimes falls under Chapter 79 of  Title 18 of the United States Code, 18 USCS § 1622 (Subornation of perjury). 18 USCS § 1622  (Subornation of perjury) sets forth in principal part:Whoever procures another to commit any perjury is guilty of subornation of perjury, and shall be fined under this title or imprisoned not more than five years, or both.A fourth serious federal crime falls under Chapter 13 of Title 18 of the United States Code. 18 USCS § 242 (Deprivation of rights under color of law). 18 USCS § 242 (Deprivation of rights under color of law) sets forth in principal part:Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both. . . .By betraying their oath to uphold the laws of this Nation, they have deprived the citizens of this Nation of their rights as they have attempted to subvert election laws by allowing an ignominious individual, Hillary Clinton, to campaign for the highest Office in the Land, when Clinton should, instead, have been indicted on several criminal charges. The website, Sean Hannity "Release the Memo," further elucidates the point raised and expounded upon on Hannity's evening program. If, as almost certainly appears to be the case, senior officials of the DOJ and/or FBI deliberately destroyed messages—amounting to pre-emptive document deletion or shredding—in anticipation of civil or criminal investigation of wrongdoing, this amounts to anticipatory obstruction of justice and they may be subject to criminal liability under the obstruction of proceedings Statute mentioned, supra.

That will pave the way for President Trump to nominate at least one and conceivably two, and optimally three more American jurists, to sit on the high Court who, as with Trump’s nominee, Judge Neil Gorsuch, hold jurisprudential values and who would apply the same methodology to deciding cases as do Justices Clarence Thomas, and Samuel Alito, which the late Justice Antonin Scalia had set the course. With strong and true conservative-wing Justices on the high Court, who hold a clear majority, we will see the Court agreeing to hear critical Second Amendment cases and, thereupon, rendering decisions that, with the Court’s untarnished and supreme judicial imprimatur, makes clear the import of the natural, fundamental rights and liberties of American citizens as codified in the Bill of Rights of the U.S. Constitution in the manner the framers’ intended.

THE ARBALEST QUARREL LOOKS BACK ON WORK COMPLETED IN 2017 AND THEN FORWARD TO OUR TASKS FOR 2018

WHAT WERE SOME OF OUR ACCOMPLISHMENTS IN 2017?

Let us step back for a moment and look at just a few of the tasks we completed in 2017, and remark briefly on tasks we have set for ourselves in 2018. Much of our work, consistent with the primary purpose of the Arbalest Quarrel involved detailed, comprehensive analyses of critical federal and State Court cases impacting the Second Amendment. One of those cases is Soto vs. Bushmaster Firearms International, LLC., 2016 Conn. Super. LEXIS 2626; CCH Prod. Liab. Rep. P19,932. Soto is an active case. The Soto case arises from the deadly attack that occurred on December 14, 2012, in Newtown, Connecticut, when a deranged young adult, Adam Lanza, 20 years old, stormed Sandy Hook Elementary School, fatally shooting twenty children and six adults, before turning a handgun on and killing himself. According to the allegations of the Soto Plaintiffs' First Amended Complaint (CM), Adam Lanza murdered these school children and school staff with a Bushmaster AR-15, model XM15-E2S rifle. Defendant Bushmaster prevailed in the lower Superior Court (trial Court), and we analyzed the Superior Court decision in depth. Plaintiffs appealed the adverse decision directly to the Connecticut Supreme Court, bypassing the State Court of Appeals, and the Connecticut Supreme Court agreed to hear argument. We will be analyzing the Briefs of Plaintiffs and Defendants in the case and will also analyze selected amicus (friend of Court) Briefs in that case. Over 50 amicus briefs were filed in that case. We also provided comprehensive analyses in an “assault weapons” case, (Kolbe vs. O’Malley, 42. F. Supp. 3d 768 (D. Md. 2014); vacated and remanded, Kolbe vs. Hogan, 813 F.3d 160 (4th Cir. 2016); rev’d en banc, Kolbe vs. Hogan, 849 F.3d 114 (4th Cir. 2017) ), which we had hoped would be taken up by the U.S. Supreme Court—the high Court failing to have granted certiorari in an earlier disastrous “assault weapons” case, Friedman v. City of Highland Park, 784 F.3d 406, 2015 U.S. App. LEXIS 6902 (7th Cir. Ill., 2015). Alas, the high Court failed to garner four votes, allowing the case to be heard in the high Court. Had the high Court agreed to hear the case, Americans would see a definitive ruling on whether so-called “assault weapons” fall within the core of the Second Amendment’s protection. Obviously, the liberal wing of the Court and at least two "apparent" conservative wing Justices, likely, Anthony Kennedy and the Chief Justice, John Roberts, did not want to resolve this case, and, so, to date, resolution of “assault weapons” as protected firearms within the core of the Second Amendment remains in abeyance, with liberal Circuit Court of Appeal Judges ruling that semiautomatic "assault weapons" do not fall within the core of the Second Amendment and, so, are not protected.In addition, we looked at two Congressional bills that, if enacted, strengthen the Second Amendment. We looked at national concealed handgun carry reciprocity legislation, pending in Congress, H.R. 38, and looked at Congressman Chris Collins’ bill, the “Second Amendment Guarantee Act” (H.R. 3576) (“SAGA”) which has been referred to the Subcommittee on Crime, Terrorism, Homeland Security, and Investigations, on September 6, 2017 where it presently sits. We also did our part to sidetrack Obama’s attempt to sit Judge Merrick Garland on the U.S. Supreme Court. When we feel it critical that our representatives in Congress be notified of specific and extraordinary dangers presented to our Nation, we have not hesitated to contact them. When, after the passing of the exceptional U.S. Supreme Court Justice, Antonin Scalia, we have seen that President Barack Obama wasted little time in nominating a person to serve as a new ninth member of the high Court who would, given the opportunity, assist the liberal-wing Justices—Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, and Elena Kagan—in unwinding case law that Justice Scalia helped to shape in his many illustrious years on the Bench. That person who President Barack Obama had hoped to see confirmed is Merrick Garland, Chief Judge of the U.S. Court of Appeals for the D.C. Circuit. The Arbalest Quarrel took strong exception to the possibility of seeing Judge Garland sitting on the high Court. We sent a letter to the Chairman of the Judiciary Committee, Senator Chuck Grassley, requesting the Senator to refrain from allowing a confirmation hearing to proceed. Had a confirmation proceeding been held, that would have resulted in Judge Merrick Garland sitting on the high Court as an Associate Justice. Of that, we have no doubt, as U.S. Senator Orrin Hatch has articulated that point. According to the liberal political commentary website, "New Republic," Senator Hatch said that there was "no question" that Judge Merrick Garland would be confirmed were a confirmation hearing held. The Arbalest Quarrel explained the singular danger Judge Merrick Garland posed to the preservation of the right of the people to keep and bear arms, codified in the Second Amendment to the U.S. Constitution if Merrick Garland sat on the U.S. Supreme Court. In our letter we took exception to pronouncements of several academicians who had also written a letter to Senator Grassley. Those academicians argued that nothing in the record of Judge Garland’s service as a Judge on the U.S. Court of Appeals suggests that an inference can be drawn concerning Judge Garland’s jurisprudential philosophy toward the Second Amendment. We disagreed with the pronouncements of those academicians. We pointed to specific examples in the judicial record that establish beyond doubt that Judge Merrick Garland holds great and abiding antipathy toward the Second Amendment; and that Judge Garland’s antipathy toward the Second Amendment is very much in evidence in the judicial record, contrary to the pronouncements of those academicians who promote the Judge’s ascendancy to the U.S. Supreme Court. Our concern was not directed to Judge Garland’s ability as a jurist. We have no doubt that Judge Garland has a bright and, conceivably, brilliant legal mind. But, when that brilliance is coupled with a philosophy at loggerheads with the philosophy of another brilliant Justice, Antonin Scalia, then we know that preservation of the natural, substantive fundamental rights of the American citizenry—particularly the right of the people to keep and bear arms—are in jeopardy. In a series of in depth articles, we have written extensively about Judge Garland’s jurisprudential philosophy. We pointed out that Judge Garland’s judicial approach is clearly antithetical to that of the late Justice Antonin Scalia, and that Justice Scalia’s illustrious work would be undone were Judge Garland to sit on the high Court. In our letter to Senator Grassley, we provided a link to the Arbalest Quarrel website and encouraged the Senator to peruse our analytical articles on Judge Garland, as the letter only touched upon the matters of concern.

THE MISSION OF THE ARBALEST QUARREL 

The mission of the Arbalest Quarrel is to preserve, protect, and strengthen the Bill of Rights, and, principally, to preserve, protect, and strengthen the Second Amendment to the United States Constitution. The Arbalest Quarrel has written dozens of articles on newsworthy and noteworthy events, impacting the Second Amendment. Many of our articles appear in Ammoland Shooting Sports News. Most of the articles we prepare are comprehensive, extremely detailed, highly analytical expositions on Second Amendment issues. Many of our articles are written as part of lengthy, continuing series. Given the exigencies of time and of new and pressing newsworthy matters, we are often compelled to sidestep continuous work on a series, returning to a series later. Since threats to the Second Amendment are constant and continuous, much of the work that we may have left uncompleted in previous weeks or months is and remains pertinent. Some work that we do, involving analysis of active legal cases, such as the Soto case, cannot, of course, be completed until further action is taken by a Court and, in that event, we must await action before continuing discussion. In other cases, such as Kolbe, where we have commenced work, as part of a series, a higher Court, in this case, the U.S. Supreme Court has denied a writ of certiorari, which means that the ruling or rulings of the second highest Court, a U.S. Circuit Court of Appeals, remains the law in that judicial Circuit. But, as those cases involve an open-ended and critically important issue that the U.S. Supreme Court will, at some point be compelled to tackle, our analysis of lower U.S. District Court and U.S. Circuit Courts of Appeal decisions are still relevant and, so, hold more than historical value in terms of their impact on the right of the people to keep and bear arms. Kolbe, for example, deals directly with the issue whether semiautomatic weapons, defined as ‘assault weapons’ fall within the core protection of the Second Amendment. As antigun groups intend to deny American citizens the right to legally own and possess “assault weapons,” and, as they seek, eventually, to ban civilian ownership and possession of all semiautomatic weapons, it is incumbent upon us and important to consider the legal arguments they present. Thus, at some point in time when the U.S. Supreme Court does deal with the issue as to the extent of or whether semiautomatic weapons defined as ‘assault weapons’ fall within the core protection of the Second Amendment or whether semiautomatic weapons, as a broad category of firearms, fall within the core protection of the Second Amendment--and the high Court will, at some moment in time have to consider the issue--we will have addressed, in depth, all or virtually all of the salient arguments that litigants happen to make. As we look back at the work over the years, we note our article, titled “The Arsenal of Destruction.” Concerning antigun groups efforts to defeat the right of the people to keep and bear arms, what we mentioned in that article is as true then as it is today.   • DESTRUCTION OF SOVEREIGN NATION STATES AND OF THE CONSTITUTIONS OF SOVEREIGN NATION STATES THROUGH THE CREATION OF, ESTABLISHMENT OF AND INEXORABLE EXPANSION OF AN INTERNATIONAL, NEOLIBERAL INSPIRED WORLD ORDER DEDICATED TO AND WORKING TOWARD THE DESTRUCTION OF INDIVIDUAL RIGHTS, THE DESTRUCTION OF INDIVIDUAL LIBERTIES, AND THE ERADICATION OF PERSONAL AUTONOMY

We intended to do an article on each of these 21 strategies within the series. We didn’t complete the series, but we did write on several of these strategies and some of the strategies were touched upon in other articles. For example, our most recent article on the NY Times new “gag order” policy preventing its employees from exercising their freedom of free speech on their own time in vehicles other than the New York Times newspaper, actually is a response to two strategies we delineated on in “The Arsenal of Destruction":ONE: GLOBAL CENSORSHIP/CONTROL OF EXPRESSION ON THE INTERNET: UNDERMINING THE SECOND AMENDMENT BY CONTROLLING MESSAGING WITH THE AIM, ULTIMATELY, OF INSIDIOUSLY DESTROYING THE SECOND AMENDMENT THROUGH AN UNCONSCIONABLE INFRINGMENT UPON THE FIRST AMENDMENT: AS CONTEMPT FOR ONE AMENDMENT OF THE BILL OF RIGHTS IS SHOWN, SO, AS WELL, IS CONTEMPT FOR THE OTHERS DEMONSTRABLY SHOWN; and,TWO: USE OF PROPAGANDA AGAINST THE AMERICAN PUBLIC AND INDOCTRINATION OF THE PUBLIC BY MAINSTREAM NEWS MEDIA GROUPS.Our principal mission and raison d’etre—as mentioned, supra—is to preserve, protect, and strengthen the Second Amendment to the U.S. Constitution. In fact, the preservation of, protection of, and strengthening of the Second Amendment all go hand-in-hand. There exist forces both inside and outside this Country that would like to repeal the Second Amendment. Of course, they realize that repealing, de jure, any one of the Ten Amendments to the U.S. Constitution that comprise the Bill of Rights is virtually impossible. As natural rights, there is no mechanism for repealing these rights and liberties anyway, since no man created them. The Framers of the Constitution merely codified the rights that exist intrinsically in each American citizen. That doesn’t mean that a sacred right cannot be ignored or de facto repealed which effectively reduces the right to a nullity even as the words remain intact. Thus, if the words remain, but the intent behind the words is absent, hollowed out, the right, in essence, ceases to exist. We have seen this before. The fundamental right of Americans to be free from unreasonable searches and seizures has been hollowed out, as Government agencies like the CIA and NSA download and keep digital records on everyone and everything. This is patently illegal, but Federal Government agencies do it anyway. The fundamental right of free speech is beginning to be hollowed out, too, as censorship, in the guise of “political correctness” is taking its toll on free speech. The fundamental right of the people to keep and bear arms was dying a slow death until the majority of the U.S. Supreme Court in two seminal cases, District of Columbia vs. Heller, 554 U.S. 570; 128 S. Ct. 2783; 171 L. Ed. 2d 637 (2008), and McDonald v. Chicago, 561 U. S. 742, 780, 130 S. Ct. 3020, 177 L. Ed. 2d 894 (2010)), made clear what that right entails. The high Court made poignantly and categorically clear that this right—a right that must be recognized by both federal Government and by the States—is an individual right, a right, then, not connected to one’s service in a militia. Still, those Legislators and Jurists who seek to disembowel the Second Amendment have either ignored the holdings of the U.S. Supreme Court or have actively tinkered with it, working around the edges of the Heller and McDonald holdings to slowly weaken the Second Amendment. But, to weaken the right is tantamount to destroying it; for the rights codified must be understood in the context the framers of the Constitution intended, as absolute imperatives. This doesn’t mean restrictions ought not be enacted that operate as deprivations on some individuals but, this deprivation is justified only if the threat posed by the one threatens the lives of millions of others, or where the threat posed by an individual undermines the sovereignty of this Nation.Consider the Second Amendment. Federal law bars persons adjudged mentally incompetent from owning and possessing firearms. Thus, the absolute right to own and possess firearms infringes the right of a person adjudged mentally incompetent but this is necessary to protect the lives of millions of innocent, law-abiding Americans. Federal law also prohibits illegal aliens from owning and possessing firearms. And, in so doing, we protect the sanctity of the notion of a Nation State comprising a unique citizenry. Antigun groups, though, don’t perceive the Bill of Rights as a set of natural rights, existing intrinsically in the individual, endowed by the Creator to the individual. They see the Bill of Rights in the same vein as do internationalist, trans-nationalist globalist “elites,” as mere man-made creations-- statutes enacted and repealed at the will and the whim of the of the rulers that draft and enact them. As they see nothing positive in the right of the people to keep and bear arms, they see nothing that mandates the preservation and strengthening of that right. So, those who attempt to restrict the right of the people to keep and bear arms do not consider restrictions on the exercise of that right from the standpoint of the restriction's negative impact on the majority of rational, responsible, law-abiding American citizens, who wish to exercise their right, but, rather, see restrictions on the exercise of that fundamental right from the utilitarian consequentialist position. Consistent with utilitarian consequentialism, it is firearms in the hands of law-abiding rational, individual, not the occasional criminal or lunatic, that is perceived as posing the real danger, the real threat. And, what is that threat? It is a threat perceived as directed against society— against an amorphous collective “hive”—a threat perceived, eventually, as one directed against the entirety of the “free” world, a free world constituted as a "New World Order." It is not the criminal or lunatic possessing a firearm that concerns those that hold to the utilitarian consequentialist theory of morality that poses the greater threat to the well-being of society. In a constant flurry of new draconian firearms bills introduced in Congress, we see, in the draft language of these bills, that it is really the average law-abiding individual--the rational, responsible, law-abiding American citizen--against whom restrictive gun measures are really targeted and leveled. These restrictive gun bills are drafted and enacted in clear defiance of the right guaranteed in the Second Amendment.Our mission, our raison d’être, is to call out those disreputable groups and to call out those legislators and to call out those Hollywood film stars and moguls and to call out those mainstream news commentators and journalists and "comedians" and to call out those inordinately wealthy, extraordinarily powerful, extremely secretive, and absolutely ruthless internationalist, trans-nationalist, globalist forces that mean—all of them—to destroy our Nation State and that mean to destroy our Bill of Rights, and that mean to do so all the while claiming their efforts have a rational, ethical basis. But their actions belie their assertions. Their actions belie their true intent. These individuals, these groups, these cold-hearted ruthless internationalist, trans-nationalist, globalist “elites” that control the levers of finance and industry, that control major media organizations, that operate within and control the Deep State of Government within our own Nation mean to destroy the sovereignty and independence of this Nation and they mean to upend and to destroy the supremacy of our laws and of our Constitution.These individuals distort truth; they sow seeds of discord; they confuse and confound the ill-informed masses by challenging the Nation's core values and by interposing false substitutes for those core values. They rail against and dare to rewrite our Nation's history. They attack our Judeo-Christian ethic and our Christian heritage and traditions. They mean to destroy our Nation and our sacred Bill of Rights to pave the way for an antireligious, morally bankrupt trans-global corporate New World Order conglomerate—an amorphous, muddled indistinguishable conglomeration of once proud and unique independent Nation States—a union of populations comprising the entirety of the “free” world, which these internationalist, trans-nationalist globalist financiers and captains of industry plan to rule. We are beginning to see what this portends for the U.S. as they consolidate their power in the EU, with the assistance of their technocrats, their puppets.In their concerted effort to destroy the structure of and the very notion of the sanctity and sovereignty of Nation States, and of the sanctity and sovereignty of our Nation State in particular, we see insidious and perverse attempts by these internationalist, trans-nationalist globalist “elites”—through the mainstream media whom they control and through members of Congress whom they have bought—to play with language—to suggest that the notion, the idea of ‘American,’ of what the word ‘American’ means is simply a matter of personal belief. Why is such a ridiculous notion fostered? It is fostered for a reason. For, if what it means to be an ‘American,’ or, for that matter, what it means to be a Frenchman, or German, or Italian, or Canadian, for example, comes down to personal opinion and belief, then, the bonds between a person and that person’s Country is tenuous, amorphous, fragile, elusive, even illusive, and, ultimately, unimportant. This has serious ramifications for Nation States and repercussions for the people residing in a Nation State. Thus, if a person is to be deemed an American, for example, who simply and essentially believes him or herself to be an American, then, on that basis, alone, may presumptuously presume a right to live in this Country, to emigrate to this Country and to be endowed with all the rights and liberties that the United States Constitution provides.This open-ended concept of what it means to be an ‘American’ is deliberately and unconscionably fostered by those who seek an end to the very notion of a Nation State; who seek to portray people not as citizens of this or that Country but, literally, as “citizens of the world”—who may freely move about as they wish. This “open borders” philosophy is anathema to the concept of the primacy and sovereignty of Nation States which demands that independent, sovereign Nation States have a right and duty and responsibility to maintain and control their borders, and, in so doing, forestall emigration of undesirables to this Country. To allow essentially anyone and everyone to emigrate to this Country, is to denigrate and ultimately destroy the very foundation of the sovereignty and independence of a Nation State. A Nation State’s core ethical and religious and social values are in danger of erosion. That Nation’s historical roots are in danger of erosion. That Nation’s jurisprudential values and core economic principles are in danger of erosion.When educators, along with news organizations and legislators in the United States proclaim that illegal aliens are Americans, the Arbalest Quarrel has stepped in to set the record straight. THE WORK AHEAD FOR THE ARBALEST QUARREL IN 2018

In 2018 we will continue to analyze federal and State gun laws; federal and State gun bills; and federal and State Court cases. We anticipate seeing one and perhaps two openings on the U.S. Supreme Court. It is imperative that President Trump have the opportunity to nominate one or more individuals to serve on the U.S. Supreme Court.It is in the Courts, no less than in Congress that our Bill of Rights and, especially, our Second Amendment, will be preserved, strengthened, and expanded. We will otherwise see our Bill of Rights debilitated, weakened, and restricted.The House and, more importantly, the U.S. Senate must remain firmly in the hands of Republicans and, more especially, in the hands of those who espouse a conservative philosophy, reflective of the views and philosophy and sensibilities of the Founders of our Nation, the Framers of our Constitution, the Creators of our Free Republic—not those Centrists like Paul Ryan and Mitch McConnell, who hold to a decidedly globalist philosophy, who demonstrate globalist sympathies, and whose support of our Bill of Rights is lukewarm at best.The Democrats intend to take control of both Houses of Congress and they intend to weaken our Bill of Rights and to weaken especially the First Amendment Freedom of Speech, and the Second Amendment right of the people to keep and bear arms. They intend, in league with their internationalist, trans-nationalist, globalist benefactors, to weaken, debase and eventually curtail our natural, fundamental rights and liberties. For they mean to draw us insidiously into the arms of a New World Order. They intend to do this through the vehicle of international pacts and treaties and through mainstream news organizations that condition the American public to accept open borders and to accept an amorphous notion of what it means to be a citizen; and by conditioning the American public to accept the legitimacy of foreign courts to hear cases impacting our fundamental rights; and to condition the American public to accept the supremacy of international law over that of our Constitution, and over our system of laws, and over our jurisprudence; and to condition the public to accept historical revisionism, to accept bizarre, alien notions of morality and gender identity; and to condition the public to accept the dismantling of a Nation that is grounded in Christianity and in notions of self-reliance and initiative, individual responsibility. All these things are on the table, as Democrats and many Centrist Republicans seek to weaken the foundation of a Nation as designed and understood by the Founders of it.

IN CLOSING, WE SET FORTH THE FOLLOWING POINTS AND CAUTIONARY IMPERATIVES FOR OUR READERS:

If the American people are to maintain their unique roots, we must work, first and foremost to keep sacred the Bill of Rights, and that means we must understand the import and purport of the Bill of Rights as the drafters intended, and we must insist that rights and liberties be preserved, protected, and strengthened. We must argue for the continued primacy of this Country as a sovereign, independent Nation State and we must insist that the federal Government’s first order of business, as servants of the American people, is to see to the needs of and well-being of, and security and safety of the American people. And, who are the American people? They are the citizens of this Country and those citizens, the American people, do not include anyone who resides here illegally, whatever that person's motive or circumstance for being here. And, no individual who resides elsewhere has a right to emigrate to this Country simply because that person seeks to live here, for good or for ill; and no one who has entered this Country illegally, whether consciously or through no fault of their own, can demand, as a matter of right, as a matter of law, the right to remain here. For law is not ad hoc. If Congress deigns to allow illegal aliens to remain here, then Congress must refrain from granting such individuals, citizenship. For, to grant citizenship to those who have consciously or not ignored our law, or who claim an exception to law that does not presently exist in law will serve only to destroy our system of laws. To change law or to ignore law on a whim sets a poor precedent and such action, in the seeming moral sense of it, will destroy this Country from within.We must hold to our core values. We must not be seduced into accepting notions of moral and legal relativism and we must not fall prey to historical revisionism. These notions are poisonous, pernicious, debilitating. We are a People with one common language, English. No Nation has remained a separate and distinct Nation State that has inculcated, internalized a notion of bilingualism or multilingualism or that has abided bilingualism or multilingualism.No one, whether inside or outside Government, shall indoctrinate the American people. Each American citizen has a right to free expression and to freely express his or her mind. That an individual may wish to express an idea or to possess a physical item that another individual may personally dislike, or even abhor, so what of it? The founders of our free Republic and the framers of our Constitution did not undertake to institute or to insinuate into the natural and fundamental rights and liberties of the American people a notion of “political correctness.” Such a notion is of modern invention and vintage, designed to serve an ulterior purpose. Indeed, had the founders of our Republic thought of such an absurd concept at all they would undoubtedly have held political correctness to be decidedly politically incorrect. Nothing is more devastating or destructive to the citizenry of this Nation or, for that matter, to the citizenry of any nation state, than the sins of hypocrisy and sanctimony. Unfortunately, both are in abundance in this Nation. We can for that thank the arrogance of mainstream media and of those with power and money and influence, both here and abroad, who wish to dictate a mode of thought the rest of us are obliged to adhere to. The American people should be particularly wary of those legislators and those presumptuous “elites” who bandy about such expressions as “rule of law,” and “living Constitution,” and “open borders,” and “citizen of the world” and “job creator,” and “commonsense gun laws,” and “social Darwinism, and “identity politics,” and “political correctness.” These expressions, and there are others, have become trite and dangerous clichés, shorthand simplistic sloganeering, that are either misunderstood and therefore misused, or are otherwise given to suggest or convey something overtly positive, even exemplary, when, in fact, their utilization is meant to harm the American citizen, meant to harm you! Always be mindful of seemingly noble sounding and high-minded verbiage thrown out to the masses for consumption like so much popcorn and roasted peanuts and cotton candy. Be observant, be cautious, think critically before throwing your lot in with everyone else simply because everyone else is “doing it” or “believing it.” You are no longer in high school. There is no longer any need for you to belong to this or that “clique,” in order to "fit in."The framers of the Constitution glorified the right of the individual to be individual and to accept personal responsibility for one’s actions. Our sacred rights and liberties as codified in the Bill of Rights are a testament to that fact. That is our birthright. The right of free speech; freedom of association; the right to be free from unreasonable searches and seizures; and the right of the people to keep and bear arms. These are not mere platitudes. These are a few of the most important natural rights, codified in the Bill of Rights. They are absolute and unconditional, and they are slowly being eroded. Americans should consider, critically, how the words of a news commentator, or of a Hollywood star, or of a mega-sports star, or of a legislator, or of a financier, or of a government bureaucrat, or of a highly paid comic on nighttime  television meant to cajole or persuade Americans would impinge on or infringe those rights and liberties before you throw your lot in with them. The American People Must Demand Integrity In Government

“The supreme quality for leadership is unquestionably integrity. Eisenhower, Five Star General, Supreme Commander of Allied Forces during World War II, and 34th President of the United StatesBy failing to bring Hillary Rodham Clinton to justice, the U.S. Department of Justice has failed the American People. Only God and Congress can now right a most serious wrong. Corruption has become endemic in our Federal Government. It has become practice. Hillary Rodham Clinton, and her husband, Bill, embody corruption. They have twisted a vice into a virtue. The two of them have, in fact, raised corruption to an art form, and their supporters ignore this or are otherwise simply blind or inured to it. But, if allowed to fester, corruption, as a common Governmental practice, can and will bring the Republic. Corruption, if allowed to continue unchallenged, will inevitably destroy the U.S. Constitution, reducing our precious Constitution to empty words on a page, a document with no import, no application--a document reduced to, at best, an historical curiosity, nothing more.The Republican nominee for U.S. President, Donald Trump, understands this. He sees that those who commit crimes—especially serious crimes against our Nation and its People—must be brought to trial and, if convicted, they must be punished. Our system of laws demands this. The condoning of crime by our institutions of Government—especially by those agencies of Government our Nation relies on to root out crime and mete out justice—serves only to make a mockery of the entirety of our criminal justice system. The Department of Justice, under Attorney General Loretta Lynch, makes use of our tax dollars, of late, pursuing false claims of civil rights violations by State police agencies, yet sees no need to bring to justice one of the worst transgressors of federal law this Nation has seen—Hillary Rodham Clinton—the creature who would be Queen, clamping down on the sacred rights and liberties of all Americans as she illicitly gathers power unto herself, unto her husband, unto her Foundation and, eventually, unto the fruit of her loom. Trump realizes that, since the Justice Department has refused to prosecute Hillary Clinton, even though substantial evidence exists of serious wrongdoing on her part—evidence to support charges of violation of several federal laws—multiple counts of serious misconduct—outside counsel must be brought in to investigate and prosecute Clinton. Indictment of Clinton on felony charges will stop her bid for the U.S. Presidency at once. She will have no choice in the matter. She must forfeit her bid for the White House and shut her campaign down immediately.But insidious, powerful influences both inside our Government and outside it, and inside our Country and outside it, intend to seat their puppet, Hillary Rodham Clinton, in the White House—someone they have paid the Clintons handsomely for—that continue to pay the Clintons handsomely for—to do their bidding. Those powerful interests have made certain that the Department of Justice would handcuff itself and, in fact, the Department of Justice has handcuffed itself.Donald Trump knows this. He knows this has happened. That is why he has called for—and rightly so—outside counsel—someone completely outside Government—to step in and handle, anew, the investigation of and prosecution of Hillary Clinton and investigation of and prosecution of the Clinton Foundation on charges of having violated federal Statutes—crimes amounting to felonies.Trump’s heart is definitely in the right place. He knows that failure to bring a high Government Official to justice weakens our Constitution, defeats our system of law and order, and endangers our citizenry; for the condoning of crimes by those in high Government Office will inevitably destroy our Nation as a free Republic—a Republic rooted in rule by law, not by men. But, there is a slight problem with what he asks.

DONALD TRUMP CALLS FOR A SPECIAL PROSECUTOR TO INVESTIGATE THE CLINTONS AND THE BILL, HILLARY AND CHELSEA CLINTON FOUNDATION

On August 22, 2016, Donald Trump, the Republican nominee for U.S. President called for the U.S. Department of Justice to appoint a special prosecutor to investigate Hillary Clinton’s multiple instances of misconduct.  See, for example, the article published by Reuters, titled, "Trump calls for special prosecutor to investigate Clinton Foundation."That’s good news to be sure, but it comes a little late—hopefully, not too late. Congress should have seen to the appointment of a special prosecutor long ago. In fact, the Arbalest Quarrel has called for the appointment of a special prosecutor or independent counsel to reopen the investigation into serious misconduct on the part of Hillary Clinton all along, well over a month before Trump mentioned the need to do so. We talked about this in our article titled, "Hillary Clinton Must Be Indicted and Here's the Reason for it."We have insisted on the appointment of outside counsel to renew the investigation into Hillary Clinton’s serious misconduct, consistently, since publication of our article. Major news organizations jumped on the appointment of a special prosecutor issue only after Trump had called for such appointment.For example, Time magazine, on August 22, 2016, reporting on Trump’s call for a special prosecutor, said, that,“Under current U.S. law, independent counsel can be appointed when the Attorney General determines that an investigation by the Department of Justice ‘would present a conflict of interest for the Department or other extraordinary circumstances’ and ‘that under the circumstances, it would be in the public interest to appoint an outside Special Counsel.’”That is absolutely false. The Time reporter, Tessa Berenson who wrote the Time piece, titled, Donald Trump calls for Special Prosecutor to Investigate Hillary Clinton,” evidently has no knowledge of the current and true state of the law involving the appointment of special prosecutors or independent counsel to investigate serious misconduct of high level Officials in the Executive Branch of the federal Government. In her article Berensen says, “Under current U.S. law, independent counsel can be appointed when the Attorney General determines that an investigation by the Department of Justice ‘would present a conflict of interest for the Department or other extraordinary circumstances’ and ‘that under the circumstances, it would be in the public interest to appoint and outside Special Counsel.’”Berensen is, apparently, citing to “Ethics in Government Act of 1978.” But, the “Ethics in Government Act of 1978,”--an Act that compels integrity in public officials who work for the Executive Branch of the Federal Government--lapsed in 1999, in accordance with the sunset provision embodied in the Act, since Congress failed to extend its operation for another five years, commencing from the date of its expiration in 1999. So, Contrary to Tessa Berenson’s remarks, the U.S. Department of Justice (DOJ) cannot, at the present time, turn over federal investigations and prosecution of serious violations of federal law to special prosecutors or independent counsel even if the DOJ had wanted to; and, as we know, it doesn’t. And, Congress, for its part, cannot compel the Justice Department to turn over, to special prosecutors or independent counsel, federal investigations and prosecution of serious violations of federal law by high level Officials of the Executive Branch of the Federal Government even if it seeks to do so; and, at least two U.S. Congressmen wish to do just that.Once againand we emphasize: The authorization for the appointment of special prosecutors or independent counsel to take over investigations of serious violations of federal law committed by high level Officials of the Executive Branch of Government, along with the power to prosecute those charged with commission of felonies under federal law, died in 1999, when Congress allowed the Ethics in Government Act of 1978” to expire, in accordance with the sunset provision originally written into the law--hence the need for the Act's reauthorization. The Arbalest Quarrel wrote a comprehensive article on this, titled, The Un-Justice Department Gives Hillary a Free Pass.” We posted the article, on August 4, 2016, on our site, well before Trump, or anyone else, for that matter, discussed, in a cogent, serious and comprehensive matter, the appointment of a special prosecutor to investigate, inter alia, the serious misconduct of Hillary Clinton, relating to her use of private email servers to conduct official Government businessAfter the “Ethics in Government Act of 1978” lapsed, U.S. Representative, Mike Quigley, attempted to resurrect the “Ethics in Government Act of 1978” and similar bills, by sponsoring, on March 25, 2010, the “Transparency in Government Act of 2010,” 111 H.R. 4983. The bill went nowhere, apparently dying in Committee.On June 23, 2011, Mike Quigley tried again. He, along, with another Democrat, Jackie Speier, sponsored, on June 23, 2011, the “Transparency in Government Act of 2011,” 112 H.R. 2340. That effort, too, went nowhere. The bill died in Committee.Yet, a third time, on March 13, 2014, Representative Mike Quigley reintroduced the bill as the “Transparency in Government Act of 2014,” 113 H.R. 4245and the bill died in Committee, a third time.Then, a fourth time, Representative Mike Quigley—along with Representative Jackie Speier and, now, a third Democrat, Krysten Sinema, introduced "the Transparency in Government Act of 2015, 114 H.R. 1381." That bill was no more successful than the previous three—never getting out of Committee.Even so, had any one of these four bills passed, the most important provision of the original Act—the appointment of a special prosecutor or independent counsel to investigate and, if necessary, prosecute serious misconduct by high level Executive Department officials—was nowhere to be seen in any of the bills Mike Quigley sponsored.Now, on May 17, 2016, six months before the U.S. Presidential Election of 2016, two Republicans, Mike Turner and Rick Allen introduced a bill that, if passed, would truly resurrect “the Ethics in Government Act of 1978.” They introduced the “Independent Counsel Reauthorization Act of 2016,” 114 H.R. 5271. That bill, if passed does require the DOJ to turn over the investigation and prosecution, of cases involving serious misconduct of Executive Branch Officials, to outside counsel, namely, independent counsel, commonly referred to as “special prosecutors.” The Arbalest Quarrel insists that Congress debate this bill and vote on it before the U.S. Presidential Election—an Election that is rapidly approaching—less than three months away. If the full House votes on this bill, the American people will see, first-hand, those U.S. Representatives, both Democrats and Republicans, who demand accountability and integrity in the Executive Branch of the Federal Government, and those who do not. If the “Independent Counsel Reauthorization Act of 2016” passes, Congress will itself have the clout necessary to bring Hillary Clinton to justice. It need not rely on the Executive Branch—through its Justice Department—to police itself—something the Department—as has become depressingly, indeed, excruciatingly clear—cannot or will not do.Independent counsel need not constrain him or herself to investigate and prosecute Hillary Clinton alone. Counsel will have the power and authority of Congress to investigate and prosecute the Bill, Hillary and Chelsea Foundation, along with the principals, Bill and Hillary Clinton, for possible violations of the federal RICO Statute, 18 U.S.C. Section 1961. Congress, through independent counsel, will be able to bring down the entire corrupt Clinton Dynasty. You would think Congress would have acted well before we came to this point in time—the Eleventh Hour.Sometimes, though, as we know all too well, Congress needs a kick in the behind to get moving. The U.S. Constitution Constrains, And Was Meant To Constrain, Power Grabs By The Federal Government

A sovereign nation cannot long prevail among other sovereign nations without a central government. This is axiomatic. The founders of our Republic certainly knew this. But the founders of our Republic also knew that a nation’s central government is invariably at odds with individual liberty. A natural tension exists between government on the one hand and the rights and liberties of the citizenry, on the other. The Constitution the founders drafted for the American people is indicative of and serves, at once, as recognition of the conundrum our founders faced: that a strong central government is incompatible with individual liberty. A strong central government would eventually destroy individual liberty by amassing power unto itself at the expense of individual liberty unless a nation’s constitution places express curbs on such accumulation of power and unless the citizenry of a nation remains ever vigilant that those curbs are stringently adhered to.The founders of our Nation dealt with the conundrum by creating a Constitution that embraces three fail safe devices. The founders hoped and trusted that these three fail safe devices would operate as an effective counterforce against the destructive impulses of government to acquire ever more power for itself and, in so doing, reduce, or end altogether, the exercise of individual rights and liberties. The three fail safe devices are: one, a three branch system of government; two, clear delineation of and demarcation of the powers each branch is permitted, lawfully, to hold and wield; and three, a Bill of Rights. The three branch system of government precludes outright concentration of legislative, executive, and judicial functions in any one person or group of people. Each branch serves to check the power of the other two branches. This is what is meant by the phrase “checks and balances.” The “Separation of Powers” doctrine is also a feature of our three branch system of Government. The “Separation of Powers” means that each branch of our central – federal – Government has its own distinct function with no overlap or, at worst, with very minimal overlap.The delineation of powers each branch wields prohibits both the amassing of additional powers by that branch of Government and the encroachment of one branch of Government on the purview of the other. Each branch of Government has, then, through the exercise of a specific function, a limited set of powers. If the Constitution does not prescribe a specific power for that branch of Government, such power cannot be lawfully exercised by that branch.Lastly, the Bill of Rights secures for the people not only specific enumerated rights and liberties but reserves to the people unenumerated rights as well. The Ninth Amendment to the U.S. Constitution provides: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” And, the Tenth Amendment provides that “powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”The powers of our central – federal – Government are, then, limited, since the Constitution sets forth the powers each branch of Government may wield, consistent with the primary function of each branch. The powers residing in the States and in the people, on the other hand, are essentially open-ended. Moreover, the rights and liberties of the people are unbounded as they include both specific, especial enumerated rights and liberties and unenumerated rights and liberties. Importantly, the rights and liberties of the people, as codified in the Bill of Rights do not stem from the federal Government. They are neither a privilege bestowed by Government onto the people; nor are they a license issued by Government to the people. The rights and liberties are considered by the founders of our Republic to be preexistent in the people. The rights and liberties of the American people are neither created by government nor fashioned by the founders. The Bill of Rights simply codifies natural rights and liberties that are part of humanity that our federal Government – unlike the central governments of most other nations – are required, under our Constitution to respect.Our Bill of Rights is, in essence, a codification of and assertion of the fundamental rights and liberties preexistent in the people. That fact is clear from the context of the U.S. Constitution. Since the federal Government is not the source of those rights and liberties, the federal Government cannot lawfully circumvent those rights and liberties. If the Government were to do so, the Nation, as a free Republic, as our founders intended, would cease to exist. If anything at all remained of our Nation, it would be but ornamental coverings, trappings. The Nation – our Nation – would be merely a dried husk, an empty shell.

OUR FOREFATHERS' FEAR THAT THE FEDERAL GOVERNMENT  MIGHT ONE DAY ENCROACH UPON THE RIGHTS AND LIBERTIES OF THE AMERICAN PEOPLE IS WELL-FOUNDED

The American people are aware, today, as the founders of our Republic had long ago feared that the Nation’s federal Government’s true and natural impulse – and that of many State Governments, as well, and often at the behest of the federal Government – is to encroach on the rights and liberties of the people. We see this as the federal Government slowly but insistently encroaches on and infringes the right of the people to keep and bear arms. We are seeing State and local governments also encroaching on and infringing the right of the people to keep and bear arms. The infringement of the fundamental right of the people to keep and bear arms, is, at once, noticed by the people. For, the American people either have access to firearms or they do not. They either exercise complete control over their firearms or they do not. The right to keep and bear arms, as codified in the Second Amendment, as with all rights and liberties, is intangible, but the expression of the right – possession and ownership of the firearm – is not. A firearm is a tangible, physical object. The loss of one’s firearms to government is immediately and emphatically felt by the gun owner.The loss of other rights, however, such as the loss of “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,” may not be immediately and emphatically felt because both the right and, in many instances, the expression of that right are both intangible. Yes, the seizure of one’s papers, or smart phone, or personal computer amounts to the capture of physical items. But, the content is what the government is really after and content is intangible. If government can “lift” that content without even obtaining the physical hardware, unlawful invasion of the privacy right in that content is lost. Loss of “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,” may not be recognized but it does exist and it is no less critical to the safeguarding of a free Republic than is the Second Amendment “right of the people to keep and bear arms.”All of our rights and liberties, as codified in our Bill of Rights, are critical to our survival as a free Republic!

GOVERNMENT ATTACK ON THE FOURTH AMENDMENT

The Fourth Amendment right of the people to be free from unreasonable searches and seizures is under attack by the federal Government – most noticeably and ominously since enactment of the Patriot Act. Recently, the FBI demanded that Apple Computer, Inc., -- maker of the iPhone -- unlock the encrypted data held in the iPhone of one, Syed Rizwam Farook.You may recall that Farook, an American citizen and Islamic jihadist, together with his wife, a foreign born, non-American Islamic jihadist, went on a murderous rampage, murdering 14 American citizens and injuring another 22 in San Bernardino, California. This occurred late last year. The Government has finally acknowledged that this incident amounts to an Islamic terrorist attack on U.S. soil.The FBI has obtained Farook’s iPhone but, the content is encrypted. The FBI has said that, despite several attempts, it has been unable to unlock the phone to obtain access to the content. The FBI has therefore enlisted the aid of Apple to assist the FBI in its efforts but complains that Apple has been uncooperative. In a lawsuit filed against Apple the Government contends, as reported in mainstream newspapers, that Apple refuses to assist the FBI in unlocking the content of the iPhone. The implication is that, through its failure to comply with the FBI’s order, Apple Computer is deliberately preventing the federal Government from performing a basic function on behalf of the American people, as expressed in the Preamble to the United States Constitution: “We the People of the United States, in Order to . . . provide for the common defence . . . do ordain and establish this Constitution for the United States of America.” Is this simply an instance of a major computer company inappropriately and inexplicably refusing to assist the federal Government in the Government’s efforts to provide for the common defence of the Nation as the mainstream media, on behalf of the FBI, asserts, or is there more to this?The federal Government, through its docile and compliant servant, the mainstream media, has certainly sought to create the impression that Apple Computer’s actions are unlawful and even unpatriotic because Apple is thwarting the Government’s legitimate attempt to fight terrorism on behalf of the American people. But Apple Computer takes strong exception to the charge. In an open letter posted on the internet, Tim Cook, Chief Executive Officer of Apple, sought to exemplify and clarify the issues, saying in principal part:“For many years, we have used encryption to protect our customers’ personal data because we believe it’s the only way to keep their information safe. We have even put that data out of our own reach, because we believe the contents of your iPhone are none of our business.We were shocked and outraged by the deadly act of terrorism in San Bernardino last December. We mourn the loss of life and want justice for all those whose lives were affected. The FBI asked us for help in the days following the attack, and we have worked hard to support the government’s efforts to solve this horrible crime. We have no sympathy for terrorists.When the FBI has requested data that’s in our possession, we have provided it. Apple complies with valid subpoenas and search warrants, as we have in the San Bernardino case. We have also made Apple engineers available to advise the FBI, and we’ve offered our best ideas on a number of investigative options at their disposal.We have great respect for the professionals at the FBI, and we believe their intentions are good. Up to this point, we have done everything that is both within our power and within the law to help them. But now the U.S. government has asked us for something we simply do not have, and something we consider too dangerous to create. They have asked us to build a backdoor to the iPhone.Specifically, the FBI wants us to make a new version of the iPhone operating system, circumventing several important security features, and install it on an iPhone recovered during the investigation. In the wrong hands, this software — which does not exist today — would have the potential to unlock any iPhone in someone’s physical possession.The FBI may use different words to describe this tool, but make no mistake: Building a version of iOS that bypasses security in this way would undeniably create a backdoor. And while the government may argue that its use would be limited to this case, there is no way to guarantee such control.Some would argue that building a backdoor for just one iPhone is a simple, clean-cut solution. But it ignores both the basics of digital security and the significance of what the government is demanding in this case.In today’s digital world, the “key” to an encrypted system is a piece of information that unlocks the data, and it is only as secure as the protections around it. Once the information is known, or a way to bypass the code is revealed, the encryption can be defeated by anyone with that knowledge.The government suggests this tool could only be used once, on one phone. But that’s simply not true. Once created, the technique could be used over and over again, on any number of devices. In the physical world, it would be the equivalent of a master key, capable of opening hundreds of millions of locks — from restaurants and banks to stores and homes. No reasonable person would find that acceptable.The government is asking Apple to hack our own users and undermine decades of security advancements that protect our customers — including tens of millions of American citizens — from sophisticated hackers and cybercriminals. The same engineers who built strong encryption into the iPhone to protect our users would, ironically, be ordered to weaken those protections and make our users less safe.We can find no precedent for an American company being forced to expose its customers to a greater risk of attack. For years, cryptologists and national security experts have been warning against weakening encryption. Doing so would hurt only the well-meaning and law-abiding citizens who rely on companies like Apple to protect their data. Criminals and bad actors will still encrypt, using tools that are readily available to them.Opposing this order is not something we take lightly. We feel we must speak up in the face of what we see as an overreach by the U.S. government.We are challenging the FBI’s demands with the deepest respect for American democracy and a love of our country. We believe it would be in the best interest of everyone to step back and consider the implications.While we believe the FBI’s intentions are good, it would be wrong for the government to force us to build a backdoor into our products. And ultimately, we fear that this demand would undermine the very freedoms and liberty our government is meant to protect.”Tim Cook, on behalf of the Company, claims that the Company has cooperated with the FBI in the past and desires to continue to do so. But, according to Tim Cook, the FBI is demanding of Apple something much more ambitious than the FBI would wish for the American public to know – and something clearly dangerous to preservation of individual rights and liberty. According to Tim Cook, the FBI is ordering Apple not merely to assist it in unlocking the contents of one iPhone – that of the dead Islamic terrorist – but to develop a new operating system that, once designed and installed in all iPhones would allow the FBI to gain access to encrypted data from every iPhone the Company produces. If Tim Cook’s account of the matter is true, then the Government is demanding that Apple create – in common parlance – a backdoor key. This key would enable the federal Government to peruse, at will, the content of every iPhone that Apple manufactures. Encryption, then, can be easily defeated. If encryption can be easily defeated, then the very import of encryption ceases to exist and no iPhone is secure.Millions of people, both in this Country and worldwide, use iPhones for work and business. Apple’s customers rely on Apple to provide them with security that is impenetrable to anyone other than the owner of the phone. Apparently, Apple has been very successful on that score. But, if the FBI is requiring Apple Computer to compromise the security of every iPhone it makes – although superficially claiming interest in obtaining data from only one iPhone – then the FBI’s ambitions are far-reaching and truly ominous. The FBI is treading uncomfortably on the Fourth Amendment.To say the FBI can be trusted to use a backdoor key sparingly, wisely and consistent with our system of laws and with the U.S. Constitution, strains credulity and is naïve in the extreme, especially in light of the FBI’s past mistakes. Moreover, as Apple has pointed out, and as computer engineers from other firms concur, the creation of an iOS that bypasses security invites hacking by criminal gangs and foreign governments.It is difficult enough today for the average person and businessperson to protect his or her computer devices from the myriad viruses, worms, spybots, ransomware, and other assorted malware that daily infect computers. This has become a disturbing fact of life. Customers who spend hard-earned money on a particular smart phone, tablet, PC, and on other computer devices depend on the reputation and integrity of the manufacturer to provide the customer with a reliable device and a secure device. That the FBI would require – as Apple Computer contends – a computer device maker to compromise the integrity of all of its iPhones, not only encroaches on the Americans’ Fourth Amendment privacy interest but is also harmful to Apple’s business.The FBI has, apparently, nothing to say, about protection of the public’s Fourth Amendment privacy right, but has much to say about the idea that Apple Computer’s real interest in this matter extends merely to business concerns and maintaining its Market share. The mainstream media, on behalf of the Government, has pressed the FBI’s accusation, in lengthy news reports and commentary, pointedly attacking Apple, arguing that Apple’s reluctance to give the FBI what it wants – a backdoor key – is predicated on shallow business concerns. Even so, protection of free market capitalism is not to be construed as an improper, if unstated, motive of Apple; for our economic system, predicated on free market capitalism, is a bulwark of our free Republic. Moreover, even if – as the FBI asserts, and, as the mainstream media echoes on its behalf, and, as the public may reasonably infer and concede – Apple Computer is more interested in preserving its market share, that it fails to assert, than in protecting, as it overtly states, the iPhone user’s privacy and security – consistent with “the right of the people to be free from unreasonable searches and seizures,” – the fact that the Fourth Amendment is implicated at all is enough to warrant the American public’s grave concern in what the FBI demands of Apple. Thus, Apple’s underlying business motive in the case at bar is at most a tangential issue here, designed to divert the public’s attention away from the federal Government’s penultimate goal of creating “the surveillance society” as a conjunct of America’s “Police State.” If, in fact, as Tim Cook says, the FBI is demanding a backdoor key to unlock encrypted content on every apple iPhone, then the federal Government is in the process of undertaking a frontal assault on Americans’ Fourth Amendment “right of the people to be free from unreasonable searches and seizures,” because the sanctity of and security of sensitive personal and business data would be placed in jeopardy if Apple Computer is ultimately compelled to create a backdoor key for the FBI. Apple’s iPhones would be open to continuous unlawful federal government surveillance and to breaches by foreign governments and criminal organizations as well. Of that, there can be no doubt. One’s ability to confidently and securely protect his or her private communications and sensitive data from prying government eyes and from the nefarious actions of criminal organizations would inevitably be severely weakened.Of course, the federal Government has been attempting for some time now to compel all computer companies to provide the government with backdoor keys to enable Government to unlock, as it wishes, encrypted content held in every American’s computer devices.So, we must ask: is the federal Government, disingenuously, insidiously, even arrogantly, using the Farook episode to garner public support for further unlawful Government intrusion into the private lives of Americans, under the guise of providing for the common defence of the Nation, but contrary to the precept of the Fourth Amendment? If so, this is not something new. The public has seen this before. For the same technique has been used by antigun groups as well when seeking to garner public support for legislation to weaken the Second Amendment right of the people to keep and bear arms. Then, as now, the mainstream media willingly trumpets the call of those forces that seek to upend the Bill of Rights. The antigun groups jump on one horrific incident of gun violence, perpetrated by one or a few lunatics, or criminals, or Islamic jihadists and, through that one, particular incident, coax the public to support measures that further weaken and eventually curtail the Second Amendment right of the people to keep and bear arms. Of course curtailment of a fundamental right and basic liberty is presented to the public, not as a loss but as a benefit, namely that, for the good of society – the collective, the masses – an American must surrender his or her firearms. If you do not buy into that – and know sane, rational American should – you should not buy into the argument proffered by the FBI that, for the good of society, you must allow Government to pry into your sensitive private data – into your personal and business life – and trust that the Government will use good judgment and refrain from doing so except when necessary “to provide for the common defence” of the Nation.

NOTHING LESS THAN THE CONTINUED EXISTENCE OF AMERICANS’ FUNDAMENTAL RIGHTS AND LIBERTIES ARE AT STAKE

Americans should never for one moment doubt that Government will, if the public is not continually astute and vigilant, undermine the rights and liberties of the American people. The federal Government is continually pressing the public to relinquish its rights and liberties for such security the federal Government says it can and will provide Americans in the alternative. Americans have seen before where this has gone and they know where this is headed. Nothing good can come of it.The federal Government wishes to know what Americans are thinking. It wishes to control Americans’ thoughts and will do so by gaining entry to their secrets in derogation of the Fourth Amendment, just as it seeks to control Americans’ speech, in derogation of the First Amendment, and as it intends to control Americans’ access to firearms, in derogation of the Second Amendment. All of this is done under the guise of providing for the common defence of the Nation. But, the Nation suffers all the same as Government power increases commensurately with a decrease in the rights and liberties of the American people. What is occurring today in America is demonstrative of the founders’ greatest fear: that Government would turn on the people. As the doctrine of the separation of powers collapses, as the parameters of Government exercise of power extends, and as the rights and liberties of the American people continues to erode, the continued existence of our Nation as a free Republic begins to crumble.Congressional Republicans and Democrats who play along with the carefully orchestrated charade and pretense of providing for the common defence of the Nation are not doing Americans a service. They should be protecting Americans rights and liberties. They are not. Instead, they are actively, insidiously, at work destroying those very rights and liberties, in defiance of and contemptuous of the oath of Office they have taken. They are a disgrace to this Nation and to its People.The web blog, Salon, had an interesting point to make about Governmental lust for power, desire for control over the citizenry, and its attack on the Fourth Amendment, when it stated the other day:“Security officials keep the public focus on the limits of surveillance rather than on its excesses; at the very same time, the frequent exposure of new surveillance capacities perversely functions to normalize those excesses. If widespread surveillance is ordinary, it cannot be shocking. Instead, the anomaly becomes whatever surveillance capability lies just beyond law enforcement’s capability or authorization.”If Americans are to place their faith in something of value, that faith should rest first and foremost in the Bill of Rights. Americans’ faith will be ill-spent if that faith is placed solely in institutions of Government; in the empty words of politicians; in the propaganda spouted through the mainstream media on behalf of Government and on behalf of groups bent on destroying the Bill of Rights; in the operations of Government intelligence agencies and federal police forces who claim to provide for the common defence of the Nation, at the expense of the rights and liberties of the American people. Government, after all, does not have a vested interest in preserving Americans’ rights and liberties. It never does. The primary interest of our federal Government – indeed, of all central governments is acquisition of power for itself. If the Bill of Rights is to remain tenable, if it is to exist as something more than a mere but empty expression of the sanctity of the individual, the public must be cognizant of the natural tension that exists between a strong central government and the rights and liberties of the citizenry. If the citizenry willingly accedes to the loss of their rights and liberties, what truly remains of the Nation? Security proffered by Government? But security – real security – of the Nation – for our Nation – truly rests in the rights and liberties of the people as codified and sanctified for the people by the founders of the Nation in our Bill of Rights.
